LEGAL NOTICE
NOTICE IS HEREBY GIVEN that the Caldwell City Council will conduct a public hearing on Tuesday, July 18, 2023, be-ginning at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Community Room of the Caldwell Police De-partment, 110 S. 5th Avenue, Caldwell, Idaho in order to hear the following:
Case Number ANN23-000009: A request by The City of Caldwell to annex parcel R3583300000 (8.49 acres), located at 3905 S Indiana Avenue, in Caldwell, to include all adjacent rights of way along E Ustick Road and S Indiana Avenue, with a proposed zoning of R-3 (high-density residential) which makes the zoning in conformance with the currently adopted comprehensive plan map designation of HDR (High Density Residential). The site is currently being used as a public park known as Brothers Park. There is no proposed changes to the land use and no proposed additional development. The prop-erty is located on the NEC of E Ustick Road and S Indiana Avenue in Caldwell, Idaho.
Due to the COVID-19 pandemic, we invite interested par-ties to participate in public hearings either electronically or in person. If you have a cough, fever, or are not feeling well, please contact Planning & Zoning staff to arrange participa-tion remotely. The City of Caldwell follows the CDC guidelines to allow for distancing in the public meeting area and provide masks/hand sanitizer on site.
Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During the reg-istration process, you will be asked what item on the agenda you wish to speak about. Please use the case number as listed within the written notice.
On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public meetings” button on the center of the page. Written comments: must be received at least eight (8) days in advance of the meeting to the Planning & Zoning Depart-ment at P&Z@cityofcaldwell.org to be included within the staff report. All comments received after the staff report has been transmitted will be included in the case file and provided as late exhibits at the appropriate public hearing.

Public Information/Responsibility: For public hearing cas-es that are scheduled to be heard by City Hearing Bodies and are not heard on the noticed date: The hearing body is required to provide a “date certain” for when that case will be heard (typ-ically on the next hearing agenda but not always). Additional notices are not required and are NOT sent to property owners or posted on the site. Please check the city’s website for agen-das and updates or contact staff for the hearing date that the particular case is to be heard.
