NOTICE IS HEREBY GIVEN that the Caldwell City Council will conduct a public
hearing on Tuesday, November 15, 2022 beginning at 6:00 p.m., or as soon thereafter
as the matter may be heard. This meeting will be held in the Community Room of the
Caldwell Police Department, 110 S. 5th Avenue, Caldwell, Idaho in order to hear the
following:
Case Number ANN22-000013/SUB22-000024: A request by Michelle Landay of the
Land Group, on behalf of Marlow & Aubrey Eldridge, John & Paula Carter, Paul &
Rosalie Cope, Brett & Jacque Cope, Bob & Cheryl Cope, Lynn & Pauline Cope Trust,
and Leslie Robinson, for Annexation of parcels R32765011B0, R32765, R32765012,
R3276501100, R3276501000, R3276401100, R32764012A0 totaling 37.86 acres, with
a proposed zoning designation of R-2(Medium Density Residential). Concurrently, the
applicant is requesting approval for a Preliminary Plat for Banner Ridge Subdivision, a
phased development with a gross density of 3.94 dwelling units per acre and 9.1%
open space. The development would include 186 total lots, which includes 149 single-
family residential lots, 35 common lots, 1 common access lot, and 1 right-of-way lot.
The project is proposed to be developed in two (2) phases. Phase I will consist of 59
buildable lots (2 lots with existing homes), 2.72 acres of common lots, all required
improvements along Moss Lane and Celeste Avenue, and two (2) subdivision
entrances at Moss Lane and Celeste Avenue. Phase II will consist of 90 building lots
and 2.12 acres of common lots, including one shared driveway. The subject property is
currently in the county and has a Comprehensive plan designation of Medium Density
Residential. The subject properties are located approximately 300’ from the corner of
Celeste Ave and Moss St in Caldwell, Idaho. A development agreement will be
required if the annexation with initial zoning application is approved.
Written comments must be received at least eight (8) days in advance of the meeting to be included in the
staff report for review and consideration by the hearing body. All comments received after the staff report
has been transmitted will be included in the case file and provided as late exhibits to the Commission or
Hearing Examiner at the public hearing for consideration at their discretion. Please send comments to the

You are being notified because Idaho Code, 67-6509, Local Planning Act 67-6509, requires notice of this
public hearing to be provided to all political subdivisions providing services to the site and to all property
owners or purchasers of record who own property within 300 feet of the subject area.
Public Information/Responsibility: For public hearing cases that are scheduled to be heard by City Hearing Bodies and are not
heard on the noticed date: The hearing body is required to provide a “date certain” for when that case will be heard (typically on
the next hearing agenda but not always). Additional notices are not required and are NOT sent to property owners or posted on
the site. Please check the city’s website for agendas and updates or contact staff for the hearing date that the particular case is to
be heard.

needs an interpreter should contact the City at least 24 hours prior to the hearing.
SUGGESTIONS FOR TESTIFYING AT PUBLIC HEARINGS
1. Remember your objective…It is your objective to persuade the decision makers to vote or decide in favor of your side of the issue. It will not help your
cause to anger, alienate or antagonize the decision makers who are listening to your presentation.
2. Show your strength…Many neighborhood groups have organized their testimony by having one or a few people speak on behalf of the group. The leader
will ask those in the audience supporting the testimony to stand. This conveys to the decision makers the seriousness with which the issue is viewed by the
attending parties.
3. Speak to the point…Public officials have heard hundreds of people give testimony. They are grateful when the testimony is pertinent, well organized, and
directly regards the matter at hand. Long stories, lectures or philosophy, abstract complaints about generalities, or redundant testimony are usually a poor
use of time.
4. State your recommendation. 5. Be informed…. Get a copy of the plan being heard, the staff report, the proposed ordinance, or other pertinent material. Then read it and plan your comments
accordingly.
6. If you don’t wish to speak, write it down… and submit it prior to the hearing. If written testimony is specific, to the point and concise, it will be
given as much attention as oral testimony.
7. Be reasonable….Put yourself in the shoes of the decision makers. They must balance all points of view, interests and proposals being made, and find
the best course for the overall public good. While. Be prepared to compromise.
