Please see the request below from Andrew Wheeler regarding an appeal of the denial of Skyview Villas. In speaking with Morgan and Robin – they are concerned with the motion for the
denial made by Councilor Register on 9-5-2023. (see below)
I have attached a copy of ORD 3522 (approved on 9-5-2023) regarding the process and qualifications for a reconsideration of land-use cases, which addresses annexations. I will respond
to Mr. Wheeler that the request for reconsideration is being reviewed by legal counsel. I will copy you on my response to him.

ORDER OF DECISION ON CASE NO. ANN23-000006, CPM23-000002:
MOVED by Register, SECONDED by Williams based upon the testimony and evidence in record in this matter and upon findings of fact and conclusions of law, I move that CPM23-000006 for
a comprehensive plan map amendment for medium density residential to high density residential, to include approval of Resolution No. 23-23 and ANN23-0000006 for annexation and high
density residential zoning of parcel R356601000 be DENIED.
Councilor Register stated that her denial was based on the lack of conformity with the comprehensive plan.
Councilor McGee indicated his support of the plan due to its location and agreed that it was a natural progression of housing.
Councilor Register noted that the lot to the north would potentially develop into multi-family homes.
Roll call vote: Those voting yes: Register, Williams, Doty, and Stadick. Those voting no: McGee and Allgood. Absent and/or not voting: none.
