Dear Ms. Valdez,
I have reviewed your request for administrative approval of reduced setbacks for a pergola
located at the above address. Per Caldwell City Code 10-02-03(3), the Planning and Zoning
Director may grant a reduction of up to 20% of a required setback.
The subject parcel is located within the R-2, Medium Density Residential Zone. The
minimum required setback for a street side yard in this zone is 15 feet. A 20% reduction of
up to 3 feet is allowed, which would permit a structure a 12 foot setback from the back of
sidewalk. The property in question appears to be setback 29.5 feet from the back of curb,
which would permit a 5 foot sidewalk, 12 foot setback, and 12.5 feet for additional
structure. The plans show the pergola of having a depth of 12.5 feet.
The plans for the pergola show high quality materials and an attractive aesthetic that do
not detract from the primary structure nor the surrounding residences. Additionally, the
pergola is constructed of an open style, which reduces the appearance of encroaching into
a setback as compared to a habitable structure.
Therefore, this request for an administrative reduction of the required 15 ft. setback, not
to exceed 20%, is hereby approved. Please note that any building, fire, and engineering
requirements will still need to be met.
