Re: Administrative Determination for the Valdez’ Front-Porch Pergola
Dear Planning and Zoning Department:
At the city planning department’s request, we are pleased to submit an application for an administrative
determination enabling a front-porch pergola for Mr. and Mrs. Valdez. Previously, they hired a company to
obtain permits and construct the pergola. Then, to their surprise, they received a stop work order from the
city’s building department because a building permit had not been obtained, and the structure was incorrectly
attached to the residence and did not appear to meet the city’s front 15-foot setback requirement.
Since then, the Valdezes have coordinated with the city’s building and zoning departments to remedy
the violations. They submitted plans to the building department and paid the plan review fee but, because the
precise location of the front property boundary is unknown, it appears the pergola is in the front setback area.
The subject property is in a 1906 platted subdivision and precise property boundaries are unknown
because there have not been recent surveys using modern technology. The Valdez’ received a $2,800.00 quote
for a surveyor to identify the property boundary. Rather than spend that much money with a chance the setback
could not be met, the Valdezes decided to shorten the structure and come into compliance with Caldwell City
Code 10-02-04(2)C, which states:
A detached accessory building, structure or use less than two hundred (200) square feet in size
shall have no setback requirement but shall comply with subsection (2)(B) of this section,”
which generally prohibits encroachments in an easement or public right of way area.
The Valdezes propose and request city approval of a detached 12-foot six-inch wide by 15-foot six-
inch long (193.75 sq. ft.) pergola to cover and shade a portion of their paved, front porch area. This application
for a shorter, detached structure does not encroach into or obstruct site triangles, and complies with city code.
