AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED
FROM THE C-2 (COMMUNITY COMMERCIAL) TO THE R-3 (HIGH DENSITY RESIDENTIAL) ZONE;
DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO
AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING
ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, following the public notice and hearing procedures as required in Section
10-03-03, Caldwell Municipal Code, approved Case No. ZON23-000012 (Lexington Sky) at a public hearing held
this 16t' day of April, 2024.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following
described property should be rezoned from C-2(Community Commercial) to R-3 (High Density Residential):
This parcel is a portion of Lot 5, Block 1 of East Caldwell Urban Renewal, Phase 1 as recorded in Book 37 of Plats
at Page 24, records of Canyon County, Idaho, lying in the W % NE'/<of Section 25, T4N, R3W, BM, Canyon County,
Idaho and is more particularly described a follow:
COMMENCING at the NE comer of the SW '/4 NE % (NE 1116 Corner) of Section 25; thence S00038'58"W, 113.16
feet along the East boundary of the SW '/ NE '/, to the SE corner of Lot 6 of said Block 1; thence N88054'56"W,
332.79 feet along the South boundary of said Lot 6, Block 1 to the SW corner of said Lot 6, Block 1, the POINT OF
BEGINNING; thence N89'02'52"W, 140.00 feet to the SE comer of Lot 1, of said Block 1; thence N00'38'46"E,
252.68 feet along the East boundary of said Lot 1, Block 1 to the NW comer of Lot 5 of said@117.51 <n89d30'21"e
Block 1; thence N89030'21"E, 117.51 feet along the North boundary of said Lot 5, Block 1 to the beginning of a
tangent curve; thence Northeasterly 22.85 feet along the arc of a curve to the left, having a radius of 86.00 feet, a
central angle of 15'13'17", and a long chord bearing N81054'02"E, 22.78 feet to the NE comer of said Lot 5, Block
1; thence S00°38'46"W, 259.23 feet along the West boundary of said Lot 6, Block 1 to the POINT OF BEGINNING.
Contains 0.82 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby
instructed to so designate the same above described property on the official zoning map and other area maps of
the City of Caldwell, Idaho as R-3 (High Density Residential),
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded
and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.

ORDINANCE NO. 3564
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3564 was passed by the Council and approved by the Mayor on the 16'h day of
April, 2024. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street,
Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing summary on the 16'h
day of April, 2024, for publication on the 23`a day of April, 2024, pursuant to Idaho Code § 50-
901 A.
This parcel is a portion of Lot 5, Block 1 of East Caldwell Urban Renewal, Phase 1 as recorded in
Book 37 of Plats at Page 24, records of Canyon County, Idaho, lying in the W V2NE'4 of Section
25, T4N, R3W, BM, Canyon County, Idaho and is more particularly described a follow:
