Transmittal Date: 1/8/2024 HEARING BODY/DATE: P&Z Commission (February 14, 2024) HEARING BODY/DATE: City Council (March 19, 2024) Application Case No(s): ZOA24-000001 Project Name: Chapter 10 Zoning Ordinance and Chapter 11 Subdivision Ordinance Text Amendments Site Address: N/A Site Parcel ID: N/A Site Location N/A Applicant: City of Caldwell Planning & Zoning Department rcollins@cityofcaldwell.org Property Owner: N/A Agent / Representative: N/A Agency Notification for a Public Hearing Caldwell Planning & Zoning Department Page 2 REQUEST SUMMARY: Application Case Number(s): ZOA24-000001: A request by the City of Caldwell Planning and Zoning Department to amend Chapter 10, Article 1, by repealing, amending and relocating the section pertaining to annexation procedures, and by adding new sections pertaining to split zoning, alignment of zoning with comprehensive plan land use designations and new section combining all definitions from within the chapter; to amend Chapter 10, Article 3, section 10-03-04 and 10-03-05 pertaining to special use permits and variances, amend section 10-03-06 pertaining to fees to clarify when fees are required and how they are established; amending section 10-03-10 to include violations, penalties and enforcement and relocating all code references within Chapter 10 applicable to violations, penalties and the administrative citation process into this section, amending and relocating the annexation section from Article 1, section 10-01-08 into this article 3, under section 10-03-01 and include language addressing deannexations and preannexations, amending section 10-03-03 pertaining to amendments and reclassifications to split out and amend the requirements for zoning ordinance text and map amendments and locate those requirements into its own section in 10-03-02 within the article, and utilize the existing section 10-03-03 only for comprehensive plan procedures; repeal, amend and relocate the section pertaining to development agreements provisions previously located in Section 10-03-03 and relocate into section 10-03-11 ; amend Chapter 10, Article 11, pertaining to the article title to change from industrial airport overlay zones to overlay zoning districts and restructure the numbering format; amend Chapter 11, Article 1 of the Subdivision Ordinances, Section 11-01-03, pertaining to right of way dedication by clarifying the process for splitting a parcel when separated by a dedicated right of way and providing provisions that if a parcel is required to split due to a dedicated right of way running completing through the parcel thereby automatically creating two parcels, that this requirement would not negate their ability to apply for a future simple lot split; amend Chapter 11, Article 2, Section 11-02-01 pertaining to final plat procedures by allowing final plats to be submitted at the same time as construction drawings; amend Chapter 11, Article 2, Section 11-02-02, pertaining to preliminary plat content, by clarifying the process for changing an approved name on a preliminary plat, and relocating this requirement into the general provision section in 11-02-01 and 11-02-01, amending the language for what is required on a preliminary and final plat and the public agency notification to prevent multiple amendments in the future by allowing for language that refers to the statutory requirements and the applications and checklists developed for the preliminary plat ; amend Chapter 11, Article 2, Section 11-02-03 (1) E, pertaining to preliminary plat hearings to clarify language about preserving features is relative to the features on the site being developed; amend Chapter 11, Article 2, Section 11-02-03 (1) F, pertaining to preliminary plat expirations and time extensions to allow all time extensions to be done administratively, to amend the criteria for approval of these time extensions, to change the twenty-four (24) month expiration to thirty-six (36) months, and to limit the ability for a plat that has been expired for more than twelve (12) months to be renewed; amend Chapter 11, Article 2, Section 11-02-03(1)G, pertaining to phased subdivisions to change the one (1) year time limit between phases to two (2) years, and to clarify that the final plat for the preceding phase must be approved before a final plat application for a subsequent phase will be heard before city council. This ordinance would be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; and repeals conflicting ordinances, resolutions, and orders.
