Black Canyon Irrigation District (District) has reviewed the zoning code amendment documents supplied by the City
of Caldwell. The District has no comments on Chapter 10, Articles 1, 3, 11, and Chapter 11, Article 1 amendments.
Based on the edits to the amendments of Chapter 11, Article 2, irrigation districts are not specifically identified as an
entity to be required to receive preliminary and final plat documents as part of the overall approval process for new
development.
Under sections 11-02-03(1)(C)(5) and 11-02-03(2)(C), “Irrigation and/or drainage companies or districts” is crossed
out and assumed to be removed. The only reference to these agencies being involved is vaguely described under
11-02-03(1)(C)(15), “Other agencies as determined by the planning and zoning department”. The District should be
involved in all facets of new development review within its respected geographical boundary and along any operated
facilities. It is the District’s request that irrigation districts and/or drainage companies continue to be clearly listed as
one of the agencies to receive copies of preliminary and final plat documents for new development under
11-02-03(1)(C) and 11-02-03(2)(C), respectively.
Through the District's review of preliminary plat and final plat documents, at a minimum, it is verified that existing
services are not interfered with, and adequate irrigation water and services will be available for the new
development. Along with this, the District needs to ensure that it will be able to maintain its easements,
right-of-way, and infrastructure within the new development with no encroachments present. It is important that the
District can access its infrastructure for successful water delivery to its patrons. The District’s right to review new
developments is a crucial factor in the successful supply of irrigation water and services as expansion continues in
the Treasure Valley.
