I would like to present 4 late exhibits. One is an updated Engineering memo from July 25th, one is an updated Findings of Facts Conclusions of law and order of decision document with
changes to the conditions, an Addendum to the original Municipal Services Agreement, and the other is an updated open space document.

The project location is 152.82 acres located on the Northeast corner of Homedale and Farmway, as well as the Southwest corner of Homedale and Farmway.
The applicant is proposing out parcels R3266801200, R21518100000, R58200000 and parcel R3266801300 to be annexed into the City with an R-1 (Low Density Residential) zone.
Along with the approval of a Preliminary Plat for parcel R3266801300, approximately 145.55 acres.

400 single family are being proposed, along with a pool, pickleball or tennis courts.
A traffic impact study (TIS) was performed and reviewed by the City of Caldwell Engineering Department.

Landscaping
Proposing 10% open space w/ 14.54 acres of qualifying open space
NOTE: MSA requires10% open space
The code requires 10% open space and they provide 10%, equaling about 14.54 acres of qualifying open space.
The applicant is in compliance with all landscaping, land use separation, pathway and parking requirements.

Larry and Debra Myles– Safety concerns with Moss St. being within 75ft of their access to their home on Farmway
Public agencies were notified and asked to provide comments, the only agencies that had concerns were:
Boise Project Board of Control wants to ensure the easements are provided along Burris Lateral and Boles Lateral.
COMPASS mentioned that the growth exceeds what is projected for this area and the transportation infrastructure may not be able to support the new demands. They mention adding bike and
ped pathways between lots.
We received a written public comment from:

This letter is in stating safety concerns with Moss St., due to their access is within 75 ft of the proposed road.

The applicant shall construct Moss St. from the west side of the development all the way to Farmway Rd. to City street standards (with a hard surface). The applicant shall submit a recorded
easement for the emergency access road being provided over Parcel R32668013B0 and provisions of maintenance prior to submittal of a final plat application.
No landscaping shall be located within the easement of the Burris Lateral and the existing access shall remain a flat drivable surface.
Off-street parking space requirements for each residential lot shall be provided at time of build-out and shall adhere to City Code.

The updated FCOs have been provided to you as a late exhibit. These changes are reflected there.
The added conditions for the parcel with proposed development (not including the general conditions) are as follows:
The applicant shall submit a recorded easement for the emergency access road being provided over Parcel R32668013B0 and provisions of maintenance prior to submittal of a final plat application.
No landscaping shall be located within the easement of the Burris Lateral and the existing access shall remain a flat drivable surface.

All The major pathways (along the Burris Lateral) must be within a public access easement identified on the plat. include a trash receptacle and park bench every six hundred (600) linear
feet of pathway, and provide one streetlight for every one hundred fifty (150) linear feet of pathway. These must meet the requirements in Caldwell City Code 10-12-05. There shall be
one trash receptacle and park bench provided for every six hundred (600) linear feet of pathway area, and one streetlight for every one hundred fifty (150) linear feet of pathway area.
Said trash receptacles and park benches shall be selected from those allowed under subsection 10-12-05(8)A2 of this chapter. Said streetlights shall meet all the requirements listed
under subsection 10-12-05(14)B of this chapter.
The development must comply with the Municipal Service Agreement MS-20-01, recorded under Instrument number #2020-043549.
All landscaping buffers along Homedale Rd. must be completed with development of Phase 1 and all landscaping buffers along Farmway Rd. must be completed with development of Phase 8.
All landscape islands within the right-of-way must be numbered as a common lot.
Homeowner’s Association CCNRs: The applicant will be required to submit the CCNRs to the City staff for review approval prior to recordation; the CCNRs shall include provisions for an
architectural review committee.
Building Design. The Building Design guidelines are outlined in the Municipal Services Agreement recorded under Instrument number #2020-043549 (Exhibit 1, Attachment A). Prior to issuance
of a building permit for individual lots, the applicant shall be required to provide a letter of approval from the Chickasaw HOA architectural review committee verifying compliance
with the building design guidelines outlined in the Municipal Services Agreement, the CCNRs, and City Code.

Municipal Services Agreement/Addendum
Serves as a Development Agreement; was recorded in 2020.
Includes Design Standards for residential homes as well as engineering requirements.
The Addendum adds requirements that are specific for the proposed development today.
Staff recommends that the HOA have an Architectural Review Committee to review compliance with the design standards prior to issuance of a building permit.
There is a Municipal Services Agreement that was recorded as instrument number 2020-043549 in 2020 that states it will serve in place of a development agreement when this property annexes.
It lays out specific design guidelines, engineering requirements, and more. The addendum that was provided as a late exhibit is to add development specific conditions that are more
up to date with the current requirements from the city, as well as to the development proposal they have provided. Staff recommends that the HOA have an Architectural Review Committee
to review compliance with the design standards prior to issuance of a building permit.

Staff Analysis
Staff finds the proposed request is in compliance with Caldwell City Codes, and
Is in conformance with the comprehensive plan - Aligns with nine (9) goals and nine (9) policies.
Staff recommends that if the request is approved, it be subject to the Conditions as specified in the Findings of Facts, Conclusions of Law, and Order of Decision.
