PLANNING AND ZONING COMMISSION
REGULAR MEETING MINUTES
Wednesday, January 10, 2024 @ 6:00 pm
Caldwell Police Department, Community Room, 110 S. 5th Avenue, Caldwell, Idaho
Chair Zamora: opened the public hearing and outlined the public hearing procedures at 6:00 p.m.

None
CONSENT CALENDAR: (ALL CONSENT CALENDAR ITEMS ARE ACTION ITEMS)
1. Approve minutes for the Caldwell Planning and Zoning Commission for the November 8, 2023, special
hearing.
MOTION by Harman SECONDED by Boutros to approve the minutes for November 8, 2023, special hearing.

REVIEW OF PROCEEDINGS (OPENING STATEMENT)

NEW BUSINESS:
ACTION ITEM: CASE NUMBER ANN23-000015, CPM23-000010, SUB23-000033:
BRECKON LAND DESIGN, ON BEHALF OF PARKLAND DEVELOPMENT LLC, IS REQUESTING
ANNEXATION AND ZONING OF PARCEL R3411800000 (APPROX. 39.2 ACRES) FROM COUNTY
AG TO THE R-1 (LOW DENSITY RESIDENTIAL) ZONING DISTRICT, A COMPREHENSIVE
PLAN LAND USE MAP AMENDMENT TO INCLUDE APPROXIMATELY 18.25 ACRES OF SAID
PARCEL R3411800000 INTO THE CALDWELL FUTURE LAND USE MAP AND PROVIDE IT WITH
A DESIGNATION OF LDR (LOW DENSITY RESIDENTIAL), AND A PRELIMINARY PLAT
CONSISTING OF 242 DETACHED SINGLE-FAMILY RESIDENTIAL LOTS AND 25 COMMON
LOTS ON APPROXIMATELY 80 ACRES OF LAND IN THE EXISTING AND PROPOSED R-1
ZONING DISTRICT. THE DEVELOPMENT PROPOSAL OF 242 SINGLE-FAMILY LOTS ON
APPROXIMATELY 80 ACRES EQUATES TO A GROSS DENSITY OF 3 DU/ACRE. THE SUBJECT
PARCELS ARE LOCATED ON THE WEST SIDE OF MIDLAND BOULEVARD, APPROXIMATELY
¾ MILES NORTH OF HWY 20/26, IN CALDWELL, IDAHO.
Katie Wright (Associate Planner), 621 Cleveland Blvd., provided the staff report by outlining its contents by use
of a PowerPoint presentation.
• Fire sent in a letter advising approval
Commission Discussion and Questions: The commission discussed and asked questions on the following:
• Conditions from the fire department – Fire did an email that served as an approval.
• Application was recommended for denial by the Commission and denied by Council in 2023
• Residential estate – larger lots, lower density

• Unique developments – what makes them special? encourages innovative and unique site
development. Katie thinks layout of sight with road running through it.
• Policy 1.1 anticipated population growth adequate services and amenities are fire, sewer, water, etc.
John Breckin, (Representative), 6661 N. Glenwood St., presented the request. He addressed the following
topics: traffic, landscaping, amenities, density and how they revised this project from their initial application,
which was denied previously.
The commissioners asked about phasing and clarification on amenities. They also addressed errors in the traffic
impact statement and wanted clarification about traffic control at Hwy 20/26 and Midland Blvd. They spoke
about the need to put a traffic signal there.
Public Works Director, Robb MacDonald, advised the Commission they could place a condition that there will
be a temporary traffic light at that intersection if the applicant wants to start before ITD starts the next phase of
construction in 2024.
Mary Wall, (Engineer) 6661 N. Glenwood Dr., Garden City, spoke in favor of the request.
• Water system – assists with master plan.
Taylor Merrill, PO Box 340, Meridian, spoke in favor of the request.
• Lot sizes and homes are a good mix
• Advises phases will probably take 18 months to 2 years per phase because they want to be sure they are
producing a good product
• Aware of traffic problems – willing to work with the city
• Blackhawk, Monarch, Castle Peak, are examples of their other projects
Jim Kapika, 10284 Lincoln Rd. spoke in neutral of the request. He expressed concerns about irrigation.
Commissioner Boutros encouraged Mr. Kapika to speak with the developers.
Rebuttal:
In closing, Mr. Breckin addressed Mr. Kapika’s concern about irrigation and that he will work with him to
ensure it won’t change any of his water. He also addressed the commissioner’s concern about traffic.
MOVED by Larson SECONDED by Boutros to close the testimony portion of the public hearing.

COMMENTS FROM COMMISSION MEMBERS CONCERNING THE REQUEST:
The Commissioners spoke about conditions they’d like to apply to the FCOs to include:
• Correcting the typos in the FCOs before a vote is made
• Updating the TIS to reflect accuracy
• Adding a temporary traffic light at Midland and 20/26 should the developers choose to start the request
prior to ITD’s next phase of construction to ensure safety.
Mr. MacDonald advised if the developer doesn’t want to wait, they can put up a temporary traffic signal to move
forward. If they do want to wait, then they can with ITD’s approval. City Council has the ability to put a hold on
development; P&Z Commission can only recommend it.
