I, Sallie Palleria, (“Developer”) agree to improve the street frontage of the Scott property along Marble Front Road. Improvements shall include the following, as per Exhibit CC-1015:
Extend 4” sewer stub to Scott’s northeasterly property corner from Penteli Court.
Landscaping, sprinkler lines, shrubs and fruit trees along Scott’s frontage shall be replaced by the Developer where disturbed by roadway construction relating only to the street frontage
improvements along the Scott property.
If necessary, the Developer shall remove one tree from the southwesterly corner of Scott’s property and replace it with three (3) two-inch caliper trees.
Developer shall provide a weed barrier, topsoil and irrigation line in areas too steep for mowing where disturbed by roadway construction relating only to the street frontage improvements.
Developer shall negotiate with the Scotts to install a 6-foot high vinyl privacy fence, or similar, along the Scott’s property lines adjacent to the subdivision.
If necessary, the Developer shall relocate the Scott’s irrigation pump and accessories outside of the roadway fill.
Developer shall provide compensation for the 5-foot wide strip of right-of-way for Marble Front Road improvements adjacent to the Scott property. The compensation shall be $50,000 per
acre or $1.15 per square foot which equals the square footage cost of the subdivision land which was appraised and purchased in April of 2006.
Total compensation from the Developer to the Scotts will be for 1,594 square feet of right-of-way which equates to $1,832.53. Said compensation shall be provided to the Scotts when the
Scotts dedicate the full right-of-way to the City of Caldwell.
Road widening, curb, gutter, sidewalk and paving along Scott’s frontage of Marble Front Road shall be completed by the Developer.
We, Jeffrey T. Scott and Cheryl D. Scott, (“Owners”), residing at 2703 Marble Front Road, Caldwell, Idaho agree to dedicate 10,189 square feet of right-of-way along our frontage of Marble
Front Road with 8,595 square feet already existing as prescriptive right-of-way and an additional 1,594 square feet needed for the total of 10,189 square feet. Compensation will be
provided to us by the Developer for the 1,594 square feet of right-of-way in the amount of $1,832.53. This dedication of right-of-way will be performed to facilitate road improvements
along our frontage of Marble Front Road. These improvements will be made by Sallie Palleria during the construction of Marble Heights Subdivision. These improvements will be made
with no cost to the Scott family. We agree to this dedication of right-of-way with the terms listed above, but in no way do we agree to annex into the City of Caldwell.
