I!� 0079816e2024o0050010020022 RICK HOGABOAM CANYON COUNTY RECORDER Pgs=2 TYOUREN NO FEE ORDINANCE CALDWELL CITY OF .6Ap 3rs� BILL NO. 59 ORDINANCE NO. 3553 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R-3 (HIGH DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission) and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON23-0000010 (The Domes Church Apartments) at a public hearing held this 201h day of February, 2024, Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R-3 (High Density Residential) zone: A part of the SW % of Section 23, T4N, R3W, BM, Caldwell City, Canyon County, Idaho, more particularly described as follows: COMMENCING at the W % corner of said Section 23; thence S00015'50"E, 782.82 feet along the section line; thence S89°44'10"W, 58.38 feet to a point on the southerly right-of-way line of Interstate 84, the POINT OF BEGINNING; thence along said southerly right-of-way the following two (2) courses: S67013'59"E, 494.23 feet; thence S61'30'32"E, 663.78 feet; thence S89030'12"W, 758.48 feet to a point on the westerly right-of-way of 161h Avenue; thence N00021'40"W, 28.34 feet along said westerly right-of-way; thence N88'15'50"W, 65.21 feet; thence N50032'50"W, 201.09 feet to a point on the section line; thence N00°15'50"W, 43.78 feet along said section line; thence N50011'50"W, 259.73 feet; thence N43040'37"E, 202.32 feet to the southerly right-of-way line of said interstate 84 and the POINT OF BEGINNING. Contains 6.262 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-3 (High Density Residential), Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing summary on the 201h day of February, 2024, for publication on the 271h day of February, 2024, pursuant to Idaho Code § 50-901 A.
