THE FOLLOWING LAND USE ACTION IS THE PRIMARY FEATURE OF THIS APPLICATION:
In the matter of the request of the City of Caldwell for Final Plat approval of Arbor Subdivision No. 5; which consists of 102 single-family residential lots and 13 common lots on 13.18
acres in an R-1(Low Density Residential) zone.

I COURSE OF PROCEEDINGS
1.1 Arbor Subdivision Preliminary Plat (PUD-18P-01) was initially approved for annexation development by order of decision signed on August 20, 2018.
1.2 The development as proposed is approved for 475 single family residential lots and one (1) commercial lot on approximately 102 acres. Phase 1 and Phase 2 of Mason Creek Landing
Subdivision were recorded on August 8, 2020.
1.3 Arbor Subdivision No. 1 was recorded 8/21/2019, Arbor Subdivision No. 2 was recorded as instrument 2021-036438 on 5/20/2021. Arbor No. 3 has not been recorded but has been approved
by City Council on December 20, 2021. Arbor No. 4 was recored and approved by City Council on April 4, 2022.
1.4 On October 5, 2021 the Caldwell Planning and Zoning Department received the final plat application for Arbor No. 5, Case No. SUB22-000035.
1.5 Files and exhibits relative to this application are available for review in the Planning and Zoning Department, 621 Cleveland Blvd., as well as applicable public hearings.
II GENERAL FACTS
2.1 APPLICANT: Josh Beach, Brighton Development, 2929 W. Navigator Dr., Ste. 400, Meridian, Idaho, 83642
2.2 LOCATION: The subject property is located on the east side of Midland Blvd, north of Ustick Rd. It is located on parcel R3434201000.
2.3 PROPERTY OWNER: Brighton Development, 2929 W. Navigator Dr., Ste. 400, Meridian, Idaho, 83642
2.4 REQUEST: The applicant is requesting final subdivision plat approval for Arbor Subdivision No. 5; which consists of 102 residential lots and 13 common lots. The subdivision is located
in an R-1 (Low Density Residential) zone.
III APPLICABLE LEGAL STANDARDS

IV ENGINEERING DEPARTMENT STANDARD CONDITIONS OF APPROVAL

Re: Arbor Subdivison Phase 5 (SUB22-000035)

The Engineering Department has reviewed the proposed final plat for Arbor Subdivision Phase 5 and provides the following comments regarding the project and the submitted final plat:
The following items must be completed before signing of the final plat. These items cannot be bonded for:
The water system is not operational. The water system has been constructed but not pressure tested. Clean water samples have not been received. The final plat will not be signed, and
no certificates of occupancy will be issued until this emergency requirement is complete.
All weather surfaces are not in place. Compaction test and core sample results have not been submitted, reviewed or approved for the roadways. The final plat will not be signed, and
no certificates of occupancy will be issued until this emergency requirement is complete.
Street signs have not been installed. The final plat will not be signed, and no certificates of occupancy will be issued until this emergency requirement is complete.
The sewer system is not operational. The sewer system has been constructed but not pressure tested and video has not been submitted or approved. Interim as-builts have not been approved.
The final plat will not be signed, and no certificates of occupancy will be issued until this emergency requirement is complete.
The pressure irrigation system within the public roadway is not operational. The pressure irrigation system has been constructed but not pressure tested. The final plat will not be signed,
and no certificates of occupancy will be issued until this emergency requirement is complete.
The storm drain system located within the public roadway is not operational. The storm drain system has been constructed and passed a visual inspection by the City. Interim as-builts
have not been approved. The final plat will not be signed, and no certificates of occupancy will be issued until this emergency requirement is complete.
Construction security will have to be provided for those items which are not among the items listed above and not yet completed prior to signing of the final plat. The City has not
agreed on a bond amount for those improvements not yet constructed.
The final plat drawing has been submitted to the City of Caldwell and has been reviewed but not yet approved. The final plat drawing will have to be done in accordance with City codes,
policies, and ordinances prior to the City signing the final plat.
In an effort to expedite the addressing process of the final plat, the Engineering Dept. requests an electronic copy in AutoCAD format be returned with a revised full set bound copy
of the final plat.
V CONDITIONS OF APPROVAL
5.1 Applicant shall meet the platting requirements as set forth by City Code and in the preliminary plat approval for this final plat, and for any letters of credit required.
5.2 Recorded mylars of the final plat shall be submitted to the Caldwell Engineering Department.
5.3 One paper copy of the recorded mylar shall be submitted to the Caldwell Planning and Zoning Department.
Case No. SUB22-000035 was reviewed by the Mayor and City Council on August 4, 2022.
The Order of Decision was approved by City Council members and administratively signed by Mayor Wagoner, on August 4, 2022.
