AGENCY COMMENTS: Public agency comments were received from the following agencies. a. Nampa Highway District #1 – No comment. b. City of Nampa – No comment. c. Intermountain Gas – No objection. d. City of Caldwell Engineering Department – No issues or concerns. e. City of Caldwell Fire Department – No issues or concerns. 9. PRELIMINARY PLAT AND DEVELOPMENT BACKGROUND AND HISTORY: The preliminary plat for Adam’s Ridge Subdivision was originally approved by City Council on August 20, 2018 as SUB-18P-04. Two previous time extensions have been approved, TE-20-22 and TE22-000001. The Phase 6 Final Plat was recorded on January 27, 2023 and the entitlements on the preliminary plat would expire if the final plat for Phase 7 is not recorded by January 27, 2024. 10. APPLICABLE REGULATIONS AND GUIDING DOCUMENTS: a. City of Caldwell Zoning Ordinance No. 1451, as amended b. City of Caldwell Subdivision Ordinance, as amended c. Idaho Code, Title 67, Chapter 65, Local Planning Act 11. REQUIRED FINDINGS & APPROVAL STANDARDS – Final Plat: Caldwell City Code Section 11-02-03 (1) F outlines the Conclusions of Law for approving a Time Extension. Before the council approves a final plat, the council must find and conclude the following: 1. Time Extension is compliant with city codes. 2. The preliminary plat, as previously approved, is still in the best interests of the safety, health and general welfare of the city. 3. There have been no significant changes to city code between the date of preliminary plat approval and the application date of the time extension request that would require substantial modifications to the lot layout. 4. Any modification to the layout and design of the originally approved preliminary plat are minimal. 5. The preliminary plat still conforms with new or amended development master plans, including, but not limited to: public facilities plans, pathways and bike routes plans, parks and recreation master plans. 12. STAFF REVIEW AND ANALYSIS: The time extension application requests a 12-month time extension due to valley wide material and labor constraints as well as weather related delays, however, the applicant anticipates being able to record the plat by late spring or early summer of 2024. The request is compliant with code and meets the required findings outlined above. The proposed development is an allowed land use within the zone and complies with the intent and purpose of the zoning district. 13. CITY COUNCIL DECISION: II. CONCLUSIONS OF LAW Regarding the request for a twelve-month time extension approval for Adam’s Ridge Subdivision Preliminary Plat, TE23-000016, the City Council received and reviewed the record and finds and concludes the following: The preliminary plat has not yet expired, and the time extension request is compliant with code requirements. 4 EXHIBIT 1 Application Documents • Application • Narrative • Vicinity Map • Approved Preliminary Plat December 1, 2023 Ms. Robin Collins City of Caldwell Planning and Zoning Department Re: Adams Ridge Preliminary Plat 12 Month Time Extension Dear Ms. Collins, We are currently under construction on phase 7 of Adams Ridge. Per City Code, the phases of a Preliminary Plat must be recorded within 12 months of the recordation of the previous phase. Phase 6 of Adams Ridge was previously recorded in January 27, 2023. Because of plan construction delays (detailed below) we will miss the January 27, 2024 deadline for recording Phase 7 and thus are requesting Approval of a 12-month Time Extension of our Adams Ridge Preliminary Plat. Reasons for the Time Extension: We began engineering design work on Phase 7 of Adams Ridge well before the previous Phase 6 was even completed. After working through plan review comments with the City we were able to start construction on Phase 7 in July 2023. While we were tracking for a December 2023 completion for the phase, we hit a number of roadblocks starting in the summer and fall that significantly affected our project schedule. Our primary contractors in Adams Ridge and valley-wide experienced over-stretched work load combined with material and labor restrictions leading to consistent delays in the project. Thankfully the contractors have now worked through their labor and material struggles and are finishing the pipe work for the project and joint-trench work will begin soon. By the time the concrete and road crews start their portion of the job, the winter weather will have set in and the asphalt plants will be closed for the season. Because of this, we will highly likely miss our window for road paving and the opportunity to record the plat before January 2024. Typically, the asphalt plants will re-open in April when the weather warms up. We anticipate resuming construction operations and anticipate recording the Phase 7 plat by May/June 2022. We hope you all consider approval of this time extension for the Adams Ridge Preliminary Plat because of these contractor delay issues outside of our power and influence. These delays by the contractors are valley-wide and unfortunately a high number of communities will be delayed and miss their ability of pave in 2023. This request complied with Chapter 11-02-03(1)F of Caldwell City Code.
