None CONSENT CALENDAR: (ALL CONSENT CALENDAR ITEMS ARE ACTION ITEMS) 1. Approve minutes for the Caldwell Planning and Zoning Commission hearing held on 9/27/23; MOTION BY Boutros SECONDED BY Larson to accept the consent agenda. MOTION CARRIED REVIEW OF PROCEEDINGS (OPENING STATEMENT) OLD BUSINESS: NEW BUSINESS: ACTION ITEM: PUBLIC HEARING (QUASI-JUDICIAL): CASE NUMBER: CPM23-000009, ZON23-0000008, PUD23-000003, SUB23-000026: ARDURRA, ON BEHALF OF FLORIDA- KARCHER LLC, IS REQUESTING A COMPREHENVE PLAN LAND USE MAP AMENDMENT FROM HIGHWAY CORRIDOR AND COMMERCIAL & SERVICE, TO HIGHWAY CORRIDOR AND MEDIUM DENSITY RESIDENTIAL, TO INCLUDE APPROVAL OF RESOLUTION 216-23 ASSOCIATED WITH CPM23-000009. THERE IS A ZONING MAP AMENDMENT APPLICATION AND DEVELOPMENT AGREEMENT TO CHANGE THE ZONING FROM R-1 (LOW DENSITY RESIDENTIAL), C-1 (NEIGHBORHOOD COMMERCIAL), AND C-2 (COMMUNITY COMMERCIAL) TO 18.38 ACRES OF R-2 (MEDIUM DENSITY RESIDENTIAL) AND 44.15 ACRES OF H-C (HIGHWAY CORRIDOR) AS APPROXIMATELY IDENTIFIED IN THE MAP BELOW. CONCURRENTLY THE APPLICANT IS REQUESTING APPROVAL FOR A PLANNED UNIT DEVELOPMENT AND PRELIMINARY PLAT FOR PARCELS R3274300000 AND R3274400000 FOR KARCHER COMMONS, AN APPROXIMATELY 62 ACRE MIXED USE SUBDIVISION, WITH 336 MULTI- FAMILY UNITS, 196 TOWNHOME STYLE APARTMENT UNITS, AND 16 COMMERCIAL UNITS. THE SUBJECT PARCELS ARE LOCATED ON THE NORTH SIDE OF KARCHER RD., THE FULL WIDTH OF LAND BETWEEN INDIANA AVE. AND FLORIDA AVE., IN CALDWELL, IDAHO. Staff requested this item to be continued to the November 22, 2023 regular hearing. MOTION BY Larson SECONDED BY Harman to continue ACTION ITEM: Public Hearing (Quasi- Judicial): Case Number: CPM23-000009 / ZON23-0000008 / PUD23-000003 / SUB23-000026: for Karcher Commons until the next regularly scheduled meeting to be held on November 22, 2023. MOTION CARRIED ACTION ITEM: PUBLIC HEARING (QUASI-JUDICIAL): CASE NUMBER(S): ANN23-000013: ISAIAS VELEZ IS REQUESTING ANNEXATION OF PARCEL R3572700000 WITH A ZONING DESIGNATION OF R-2 (MEDIUM DENSITY RESIDENTIAL). THE PARCEL IS 0.43 ACRES AND HAS ONE EXISTING SINGLE-FAMILY RESIDENCE. NO REDEVELOPMENT IS PROPOSED AT THIS TIME. THE SUBJECT PARCELS ARE LOCATED ON THE NORTH SIDE OF USTICK RD., APPROXIMATELY 1,200 FEET WEST OF THE ROUNDABOUT AT INDIANA AVE., IN CALDWELL, IDAHO. Alex Jones, (Associate Planner) 621 Cleveland Blvd., provided the staff report. Mr. Jones stated ITD had no concerns and no public comments were received. He said staff recommended approval of the request subject to the conditions provided in the draft Findings of Facts and Conclusions of Law documents attached to the staff report. In response to questions from Chair Zamora, Mr. Jones replied the area that is not colored on the GIS map indicates County property that has not been annexed into the city. Isaias Martinez Velez (Applicant) 1621 E. Ustick Road spoke in favor of the request and said they would like to annex the land for future residential development. There were no further questions for the applicant from the commissioners. In response to questions from Commissioner Larson regarding current levels of development in the City, Planning and Zoning Deputy Director Morgan Bessaw stated Director Collins recently reviewed all of the approved applications over the past ten years. She said approximately 9000 dwelling that have been entitled, of which not all have been developed. Additional questions from Commissioner Larson about surrounding zoning lead Mr. Jones to explain schools are outright permitted in all residential zones. He stated the requested use of the land is compatible with the surrounding residential zones and aligns with the current comprehensive plan. Commissioner Larsen requested Planning and Zoning consider we add a school zone to the future comp plan for clarification. Deputy Director Morgan Bessaw explained Planning and Zoning is looking at creating a public zone which applies to a variety of public uses such as city parks, County and City buildings so it will be more in line with the comp plan and is expected to be completed in the 2024 year. MOVED by Boutros SECONDED by Harman to close the testimony portion of the public hearing. MOTION CARRIED Chair Zamora closed public testimony. EVIDENCE LIST FOR CASE NO. Sign-up Sheets COMMENTS FROM COMMISSION MEMBERS CONCERNING THE REQUEST: Boutros noted the character of the surrounding land uses are compatible with this annexation and zoning. Chair Zamora and Commissioner Harman agree. ORDER OF DECISION ON CASE NO. ANN23-000013 (VELEZ PERSONAL PROPERTY) MOTION BY Harman, SECONDED by Boutros based upon the testimony and evidence in record in this matter, and upon the findings of fact and conclusions of law set forth herein, do hereby determine and move as follows: The request ANN23-000013 for an annexation with a zoning designation of medium density residential, is recommended for approval, subject to the conditions of approval as presented/amended.
