Creation of Public zoning district
Sign height modification for C-4 zone in APO-1 overlay
Update to pool barrier code

PURPOSE OF PROPOSED AMENDMENTS
City code has no zoning district specific to public and quasi-public land uses.
City code has no zoning district that corresponds to the “public” land use designation in the comprehensive plan.
City code does not have provisions regulating the future development standards of public and quasi-public land uses.
City code is missing many types of public land uses in the land use schedule.
In anticipation of any airport expansion, City code needs to be brought into compliance with FAA regulations.
City zoning code does not match building code for allowable pool safety barriers.

PROPOSED AMENDMENTS
Respond to feedback from citizens and applicants about the lack of a Public zoning district to minimize unnecessary rezones and comprehensive plan amendments.
Add new text addressing the new zone including its purpose statement and any applicable footnotes throughout the chapters.
Add this land use to the land use schedule and height, lot line setback, and lot dimension table to establish allowed uses and dimensional standards.
Modify formatting and footnotes throughout these sections to ensure clarity and consistency.
Add an additional code provision for sign height in the APO-1 overlay to ensure compliance with FAA regulations.
Modify existing zoning code language for allowable pool barriers to be consistent with both City building codes and national standards.

Update this section to:
Reformat the section to more clearly define the required standards (no text changes);
Add the Public district to the table;
Add a specific footnote regarding the new Public zoning district.

Text modification to add clarification within a specific footnote in 10-02-03: Height, Lot Line Setback, and Lot Dimension Schedule following review by Legal.
Modification to 10-02-06: SIGN SCHEDULE for sign height.

2. All signage in the C-4 District shall not exceed ninety feet (90') in height, unless approved through a special use permit. Except, signs located within the APO-1 overlay
shall in no case exceed eight feet (80’) in height.

Section 10-13-04
CCC 10-13-04: Setbacks for Mixed-use Districts
Text modification to clarify the exception within the Traditional Neighborhood zone that the use of the term “commercial” includes public and quasi-public land uses, and to provide for
the same height provisions for non-residential uses as is allowed for all other commercial and public zones within the city.
Except that commercial, public and quasi-public uses shall have 0 setbacks for front, rear, interior side and street side building setbacks (in feet). Public and Quasi-public uses shall
have no maximum height limit consistent the P-D zoning district.

Swimming Pool & Spa Code
Four foot (4’) high barrier
OR
ASTM 1346 Lockable safety cover in lieu of the requirement for a fence barrier
Zoning Ordinance (10-02-04)
G. Swimming pools, in all zoning districts, shall be completely screened off with six foot (6') high fencing around all adjacent side and rear yards, and the pool shall be set back
ten feet (10') from all property lines. Barriers shall be provided and regulated under the adopted building codes regulating swimming pools and spas. (see definition of "swimming pool"
in section 10-03-11 of this chapter).

Staff analysis and
recommendations
Proposed text amendment is necessary for public convenience, necessity, or general welfare;
Proposed text amendment meets are requirements of Caldwell City Code; and
Proposed text amendments are consistent with the adopted goals and policies of the adopted comprehensive plan.
If approved, Staff recommends City Council approve Case No. ZOA23-000002, zoning ordinance text amendments to CCC 10-01, 10-02, and 10-13, as specified in the Findings of Facts, Conclusions
of Law, and Order of Decision.
