PRELIMINARY PLAT APPROVAL CRITERIA
Caldwell City Code Section 11-02-03 (1) E2 (A) through (1) E2 (E) outlines the Conclusions of Law for approving a preliminary plat. Before the commission recommends approval of a preliminary
plat and before the council approves any preliminary plat, the commission and the council must individually find and conclude the following:
The plat is in compliance with "city code";
The plat is consistent with the city comprehensive plan;
Public services and utilities are available or can be made available and are adequate to accommodate the proposed subdivision;
The plat is consistent with the city transportation master plan; and
The subdivision preserves natural, scenic or historic features, if applicable.

STAFF ANALYSIS
CHARACTER OF AREA:
The site is currently vacant and surrounded by multifamily and industrial uses. This development would bring improvements to the area and provide affordable housing to those in the community.
The area is zoned Traditional Neighborhood which allows smaller lots and higher building heights. The location is approximately 1 mile from downtown and the local grocery store.
TRAFFIC MITIGATION:
A traffic impact study (TIS) was not required.
CODE REVIEW:
The preliminary plat application submitted proposes a T-N (Traditional Neighborhood) subdivision.
“The purpose of the T-N (traditional neighborhood) zone is to create, preserve and enhance areas containing a blend of residential, small scale commercial, entertainment, educational,
office and open space uses and related establishments that are geared to serve residents within a one mile radius.
The proposed residential development is an allowed land use within the zone and complies with the intent and purpose of the zoning district.

CONFORMANCE TO THE 2040 COMPREHENSIVE PLAN:
The preliminary plat proposal is consistent with the following goals and policies from the 2040 Comprehensive Plan:
Population (Chapter 2)
Policy 1-1: Plan for anticipated population and households that the community can support with adequate services and amenities.
Land Use (Chapter 5)
Policy 1-1: Guide the growth and development of land uses in such a way that the health, safety, and general welfare of residents will be protected.
Policy 3-2: Maximize the use of land by encouraging high-density residential development in areas that have adequate services that can act as a buffer between less dense residential
and commercial uses, and support public transit.
Policy 4-1: Encourage development as a natural outward progression of the City's corporate boundaries and within areas that can be immediately annexed and provided with public services.
Policy 5-1: Mitigate incompatibility that might arise between agricultural uses and new development through buffering and screening strategies.
Public Services, Utilities, & Facilities (Chapter 8)
Policy 1-2: Provide for the orderly expansion of public services to meet the needs of population growth, and ensure that adequate infrastructure is in place to serve new development.
Policy 1-5: Assure that a development provides adequate water supply for fire flow
Policy 4-1: Require all new non-agricultural development in the Caldwell Area of Impact be connected to potable water and city sewer service.
Policy 4-3: Require new development to meet the City’s public infrastructure design standards,and any other applicable public entity’s adopted policies.
Transportation (Chapter 9)
Policy 1-2: Seek developer participation in roadway improvement costs that are uniquely attributable to new development.
Policy 1-4: Design local streets in a manner that provides good interconnectivity as well as connectivity to adjacent developments.
Policy 2-1: Ensure that lots have sufficient frontage and/or accessibility to public streets to mitigate public health and safety concerns.
Policy 3-3: Upgrade older sidewalks and build new sidewalks in locations where they do not currently exist.
STAFF RECOMMENDATION
Based upon a thorough review and analysis of the proposed application requests, staff is recommending approval of Case No: SUB23-000007 as provided in the Findings of Facts, Conclusions
of Law, and Order found in Exhibit 1; subject to the conditions as listed within the Findings of Facts, Conclusions of Law, and Order found in Exhibit 1, Section III.
