Surrounding Area Compatibility:  The proposed use IS compatible with the surrounding zoning and/or land uses.   Zoning District Regulations and Purpose Statement:  The proposed use IS compliant with the regulations and purpose of the zoning district, with the approval of the proposed comprehensive plan amendment.   STAFF RECOMMENDATION  Staff finds the project IS compliant with all applicable codes, regulations, and policies. Should Council choose to approve the request(s), staff recommends the approval be subject to the conditions listed in the Findings of Fact, Conclusion of Law, and Order. Qualified open space includes street buffers, micro-paths, pocket park, and a segment of regional pathway. Before the council approves a final plat, the council must find and conclude the following: Final plat is compliant with city codes. Final plat is compliant with the approved preliminary plat. PUBLIC NOTIFICATIONS AND COMMENTS AVAILABLE PUBLIC RECORDS: Files and exhibits relative to this application are part of the official record and were available for review in the Planning and Zoning Department located at 621 Cleveland Boulevard in Caldwell, Idaho, and at applicable public hearings. PUBLIC NOTIFICATIONS: Notice of Public Hearing was provided in accordance with Idaho Code, Title 67, Chapter 65, Local Land Use Planning Act and Caldwell City Code. PUBLIC COMMENTS: The following is a summary of public comments that were provided at the time of drafting this report. All comments are included in their entirety as a part of the official record. NAME EXHIBIT #  Prior to completion of the staff report, there were no public comments.   STAFF ANALYSIS The preliminary plat for Mason Creek Grove Subdivision (SUB20P-015) was approved by City Council on May 17, 2021. Mason Creek Grove No. 2 is the second phase of development of this subdivision with phase 1 (SUB22-000041FP) being approved on December 20, 2022. This phase of development is a single-family residential subdivision containing 58 buildable lots and 8 common lots on approximately 17.88 acres. The subject parcel is zoned R-1 – Low Density Residential. The subject final plat proposes no significant changes to the vehicular and pedestrian connectivity nor the amount of open space; the same number of building lots as approved with the preliminary plat are also proposed in this phase. Therefore, Staff finds the proposed Mason Creek Grove No. 2 final plat is consistent with all previous approvals, including the preliminary plat. Note: The total number of building lots allowed within Mason Creek Grove Subdivision is 104 residential building lots, based on the approved preliminary plat. Within the first two phases of Mason Creek Grove, 91 residential building lots have been approved. Therefore, the remaining number of lots available to be platted is 13. STAFF RECOMMENDATION Based upon a thorough review and analysis of the proposed application requests, staff is recommending approval of Case No: SUB23-000039 as provided in the Findings of Facts, Conclusions of Law, and Order found in Exhibit 1; subject to the conditions as listed within the Findings of Facts, Conclusions of Law, and Order found in Exhibit 1, Section III. CITY COUNCIL DECISION OPTIONS CITY COUNCIL OPTIONS City Council may vote to approve of the application; or City Council may vote to deny the application and state the reason for denial, and direct staff to make findings of fact to support this decision; or City Council may vote to continue the public hearing to a future public hearing date (date certain), and request additional information from staff, the applicant, or both.
