HomeMy WebLinkAboutORD 35590 ORDINANCE NO.3559 BILL NO.65 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10, ARTICLE 13, SECTION 10-13-04, PERTAINING TO SETBACKS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 10, Article 13, Section 10-13-04 of the Caldwell City Code is hereby amended, as follows: 10-13-04: SETBACKS: Zoning building setbacks, maximum building height and lot dimensions shall be as follows: Description T-N H-C Description T-N H-C Maximum building height (in feet) 55 65 Front building setback 5 10 Rear building setback 10 0 Interior side building setback 0 0 Street side building setback 5 10 Highway frontage building setback n/a 40 Minimum interior lot area (in square feet) 0 0 Minimum corner lot area (in square feet) 0 0 Minimum interior lot width 0 0 Minimum corner lot width 0 0 Minimum interior lot frontage 0 0 Minimum corner lot frontage 0 0 Except that commercial. public and quasi -public uses shall have 0 setbacks for front, rear, interior side and street side building setbacks (in feet). Public and Quasi -public uses shall have no maximum height limit consistent the P-D zoning district. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Ord. 3559 — Page 1 Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. ATTEST: City Clerk (or Deputy) Ord. 3559 - Page 2 ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3559 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10, ARTICLE 13, SECTION 10-13-04, PERTAINING TO SETBACKS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. Section 1: Amends Caldwell City Code Section 10-13-04, pertaining to special events, by removing the restriction of special plaza events for triggering the authority of the plaza operator. Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3559 provides an effective date, which shall be on the 261 day of December, 2023. Ordinance No. 3559 was passed by the Council and approved by the Mayor on the 19' day of December, 2023.
