HomeMy WebLinkAboutORD 3555ORDINANCE NO.3555 BILL NO.61 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10, ARTICLE 01, SECTION 10-01-039 PERTAINING TO THE PURPOSE OF THE PUBLIC DISTRICT; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 10, Article 1, Section 10-01-03 of the Caldwell City Code is hereby amended, as follows: 10-01-03: ZONING DISTRICTS PURPOSE STATEMENTS: (1) District Purpose Statements: The following zoning districts and related purpose statements are hereby established: D. Institutional And Public Districts: 1. A-D AIRPORT DISTRICT: The purpose of the airport district is to provide areas by zoning procedures in accordance with the comprehensive plan that create an environment for developing the facilities necessary or desirable for the safe, efficient, convenient and economical operation of the Caldwell Executive Airport or any other similar airport. Uses in the airport district zone provide support for airport operations, services to airport users, and protect the public interest and investment. 2. C-D COLLEGE DISTRICT: The purpose of the college district zone is to provide areas by zoning procedures in accordance with the comprehensive plan that create, preserve and enhance areas containing residential, commercial, industrial, and related establishments and uses commonly found adjacent to college education facilities. Uses are to be restricted to those primarily required by educational users and providers including, but not limited to: teaching, housing, research, athletic recreation and competitions, public gathering facilities, general shopping and retail, healthcare, research activities, and complementary uses appropriate to the zone. 3. H-D HOSPITAL DISTRICT: The purpose of the hospital district is to provide areas by zoning procedure in accordance with the comprehensive plan that provide health, medical, and related services at the major medical institutions in the city and in the immediate area surrounding such institutions. Uses which support services to the health and medical uses are also permitted. Such support services would have similar low intensity land use characteristics to limited office and multi -family residential uses. Ord. 3555 — Page 1 4 P-D PUBLIC DISTRICT: The purpose of the public district is to have a corresponding zone for the public and quasi -public land use categories in the comprehensive plan. The intent of this zoning category is to allow for necessary civic uses in the community, such as schools post offices public (federal state city and county) buildings parks and recreation facilities public open space, public utility yards and similar uses. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 19th day of December, 2023. ATTEST: Mayor Jarom Wagoner City Clerk (or Deputy) Ord. 3555 — Page 2 ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3555 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10, ARTICLE 01, SECTION 10-01-03, PERTAINING TO THE PURPOSE OF THE PUBLIC DISTRICT; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. Section 1: Amends Caldwell City Code Section 10-01-03, pertaining to special events, by removing the restriction of special plaza events for triggering the authority of the plaza operator. Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3555 provides an effective date, which shall be on the 261 day of December, 2023. Ordinance No. 3555 was passed by the Council and approved by the Mayor on the 19' day of December, 2023.
