ORDINANCE NO. 3529
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE H-C (HIGHWAY CORRIDOR) AND THE R-2 (MEDIUM RESIDENTIAL) ZONE;
DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission)
and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON23-000008 (Karcher Commons) at public hearing held this lVh day of
December, 2023.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to H-C (Highway Corridor) and the R-2 (Medium
Residential) zone:
H-C ZONE
A parcel of land located in the S '% SW '% of Section 11, T3N, R3W, BM, Canyon County, Idaho, more
particularly described as follows:
COMMENCING at the NW corner of SW % SW %; thence S00°35'27"W, 470.20 feet along the west
boundary thereof to the POINT OF BEGINNING; thence N89°41'43"E, 1325.42 feet to the east boundary
of the SW '% SW %; thence S00°33'56"W, 381.20 feet along said boundary; thence S89°24'02"E, 264.47
feet to the beginning of a tangent curve; thence Northeasterly along said curve to the left having a radius
of 150.00 feet, an arc length of 222.75 feet, a central angle of 85005'09", and a long chord bearing
N48°03'23"E, 202.84 feet; thence tangent from said curve, N05°30'49"E, 32.40 feet to the beginning of a
tangent curve and the southerly continuation of the centerline of Sawgrass Drive; thence along said
continuation and centerline Northerly along said curve to the right having a radius of 350.00 feet, an arc
length of 269.87 feet, a central angle of 44010'44", and a long chord bearing N27036'11"E, 263.24 feet;
thence tangent from said curve, N49041'33"E, 32.31 feet; thence leaving said centerline, S40°18'25"E,
30.00 feet to the exterior boundary of Sawgrass Village Subdivision No.1, Book 41 of Plats at Page 27,
records of Canyon County, Idaho; thence along said exterior boundary the following courses: S49°41'33"W,
32.31 feet to the beginning of a tangent curve; thence Southerly along said curve to the left having a radius
of 320.00 feet, an arc length of 246.74 feet, a central angle of 44010'44", and a long chord bearing
S27036'11"W, 240.67 feet; thence non -tangent from said curve, S69°28'09"E, 102.48 feet; thence
N49°41'35"E, 490.10 feet; thence S89025'43"E, 411.87 feet to the east boundary of said S'/ SW %; thence
leaving said exterior boundary, S00033'40"W, 860.07 feet along said east boundary to the north right-of-
way of Karcher Road; thence along said right-of-way the following courses: S89°41'35"W, 1325.69 feet;
thence N00°33'56"E, 10.00 feet; thence S89041'35"W, 781.01 feet; thence N00018'43"W, 20.00 feet; thence
S89°41'35"W, 465.35 feet; thence N35°48'09"W, 73.71 feet to the east right-of-way of S. Indiana Avenue;
thence along said right-of-way the following courses: N00035'12"E, 93.94 feet; thence N89025'08"W, 35.35
feet to the west boundary of said S '/: SW%; thence N00035'27"E, 624.72 feet along said boundary to the
POINT OF BEGINNING. Contains 44.152, acres more or less.
R-2 ZONE
A parcel of land located in the S '/z SW % of Section 11, T3N, R3W, BM, Canyon County, Idaho, more
particularly described as follows:
BEGINNING at the NW corner of SW % SW %; thence N89°41'43"E, 1325.21 feet along the north boundary
thereof to the NE corner of said SW'/< SW'/. and the west boundary of Sawgrass Village Subdivision No.
2, Book 45 of Plats at Page 22, records of Canyon County, Idaho; thence along said boundary the following
courses: S00°33'56"W, 220.89 feet; thence S46°39'07"E, 583.96 feet to the beginning of a non -tangent
curve; thence laving said boundary, Southerly along said curve to the left having a radius of 350.00 feet,
an arc length of 65.85 feet, a central angle of 10046'45", and a long chord bearing S10054'12"W, 65.75 feet;
thence tangent from said curve, S05030'49"W, 32.40 feet to the beginning of a tangent curve; thence
Southwesterly along said curve to the right having a radius of 150.00 feet, an arc length of 222.75 feet, a
central angle of 85°05'09", and a long chord bearing S48003'23"W, 202.84 feet; thence tangent from said
curve, N89024'02"W, 264.47 feet to the east boundary of said SW '% SW %; thence N00'33'56"E, 381.20
feet along said boundary; thence S89041'43"W, 1325.42 feet to the west boundary of said SW '% SW %;
thence N00'35'27"E, 470.20 feet along said boundary to the POINT OF BEGINNING. Contains 18.383
acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as H-C (Highway Corridor) and the R-2 (Medium Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3529 was passed by the Council and approved by the Mayor on the 191 day of December,
2023. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 191 day of December, 2023,
for publication on the 26' day of December, 2023, pursuant to Idaho Code § 50-901 A.
