A RESOLUTION OF THE URBAN RENEWAL AGENCY OF THE CITY OF
CALDWELL, IDAHO, ("AGENCY") APPROVING THE REPLACEMENT OF
ATTACHMENT 9 TO THE DISPOSITION AND DEVELOPMENT AGREEMENT
BETWEEN THE AGENCY AND TS DEVELOPMENT, L.L.C.
WHEREAS, on November 14, 2023, Agency approved a Disposition and Development
Agreement with TS Development, LLC ("DDA") for redevelopment of the property commonly
known as 510 Arthur and a portion of current Arthur Street right-of-way; and
WHEREAS, the DDA included Attachment 9, setting forth the terms and conditions
applicable to the southeasterly portion of the to-be vacated Arthur Street right-of-way; and n
WHEREAS, the parties agree to replace the Attachment 9 presented with the DDA at the
November 14, 2023 Agency meeting with the version of Attachment 9 attached to this
Resolution and incorporated here by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF THE URBAN RENEWAL AGENCY OF THE CITY OF CALDWELL, IDAHO:
Section 1: Agency hereby approves and accepts that certain Attachment 9, a copy of
which is attached and incorporated by this reference, to replace the Attachment 9 originally
appended to the DDA between the Agency and TS Development, L.L.C. that was approved by
the Agency at its regular meeting on November 14, 2023.
Section 2: This Resolution shall be in full force and effect immediately upon its
adoption and approval.
