ORDINANCE NO. 3520
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE R-3 (HIGH DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE
IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures as required in Section 10-03-03,
Caldwell Municipal Code, approved Case No. ZON23-000007 (Lenity Apartments Phase 2) at a public
hearing held this 71h day of November, 2023.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to R-3 (High Density Residential) zone:
A parcel of land located in the E '/2 of Government Lot 2 of Section 3, T3N, R3W, BM, City of Caldwell,
Canyon County, Idaho, more particularly described as follows:
COMMENCING at the NE corner of said Government Lot 2, from which the '/, corner common to Section
3, T3N, R3W, BM, and Section 34, T4N, R3W, BM bears N89°53'03"W, 1322.04 feet; thence on the east
boundary line of said Government Lot 2, S00029'31"W, 687.84 feet; thence N89030'28"W, 30.00 feet to the
west boundary line of a 30 foot parcel of land as conveyed by a Warranty Deed recorded as Instrument No.
2019-000934, records of Canyon County, Idaho, and the POINT OF BEGINNING; thence S00029'31"W,
703.62 feet on said west boundary line to the south boundary line of said Government Lot 2; thence
S89052'18"W, 630.57 feet on said south boundary line to the west boundary line of the E '/z of said
Government Lot 2, thence N00°28'21"E, 710.45 feet on said west boundary line, thence S89030'28"E,
630.77 feet to the POINT OF BEGINNING. Contains 10.236 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-3 (High Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3520
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3520 was passed by the Council and approved by the Mayor on the 5t" day of December,
2023. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 5th day of December, 2023,
for publication on the 121h day of December, 2023, pursuant to Idaho Code § 50-901A.
A parcel of land located in the E '/2 of Government Lot 2 of Section 3, T3N, R3W, BM, City of Caldwell,
Canyon County, Idaho, more particularly described as follows:
