BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON23-000004 (Escalon Park) at a public hearing held the 71h day of November, 2023. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to H-C (Highway Corridor) zone: A parcel of land located the NW '/4 of Section 29, T4N, R2W, BM, City of Caldwell, Canyon County, Idaho more particularly described as follows: BEGINNING at the''/4 corner common to Sections 20 and 29, T4N, R2W, BM, from which the Section corner common to Sections 19, 20, 29 and 30, T4N, R2W, BM, bears S89050'38"W, 2640.70 feet; thence S00010'26"E, 1354.57 feet on the north -south centerline of said Section 29; thence S89032'33"W, 1364.16 feet to the centerline of the Mason Creek Drain; thence N00'26'32"W, 589.45 feet on said centerline; thence N89033'28"E, 203.00 feet; thence N00026'32"W, 437.93 feet; thence N01 °08'24"W, 83.04 feet; thence N00009'11 "W, 250.34 feet to the north boundary line of said Section 29, thence N89°50'38"E, 1167.27 feet on said north boundary line to the POINT OF BEGINNING. Contains 39.039 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as H-C (Highway Corridor). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing summary on the 5th day of December, 2023, for publication on the 12th day of December, 2023, pursuant to Idaho Code § 50-901A.
