PUBLIC MEETING INFORMATION
CITY OF CALDWELL
We invite interested parties to participate in public hearings either electronically or in person. If you have a cough, fever,
or are not feeling well, please contact Planning & Zoning staff to arrange participation remotely. The City of
Caldwell follows the CDC guidelines to allow for distancing in the public meeting area and provide masks/hand
sanitizer on site.
Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During the
registration process, you will be asked what item on the agenda you wish to speak about. Please use the case number
as listed within the written notice.
On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public meetings”
button on the center of the page. After registration, you will receive a confirmation email containing information

Written comments must be received at least eight (8) days in advance of the meeting to the Planning & Zoning
Department at P&Z@cityofcaldwell.org to be included within the staff report. All comments received after the staff
report has been transmitted will be included in the case file and provided as late exhibits at the appropriate public
hearing.

1. Motion to amend the agenda for New Business Item #5 to remove the proposed amendment to Chapter 10,
Article 11, Section 10-11-05, Caldwell City Code, pertaining to noise sensitive uses within the APO-1
Airport Overlay zone, by identifying additional land uses to be permitted when accompanied with a signed
and recorded Avigation Agreement Grant to the City by the property owner from the request under OA-23-
01.

1. ACTION ITEM: Public Hearing (Quasi-Judicial) Case Number(S) ANN23-000007, SUP23-000004 (Lavender
Crossing); A request by Riley Planning Services LLC, on behalf of Justin Fishburn, Gennie Fishburn, and
Yellowstone Capital LLC, to annex parcel R3247801000 (approx. 8.18 acres) and R3248700000 (approx. 5.84
acres) with a proposed R-3 (High Density Residential) zoning designation, where designate HDR (High Density
Residential) in the 2040 Comprehensive Plan, to include approval of a development agreement associated with
ANN23-000007. Concurrently, the applicant is requesting approval for a special use permit for Lavender Crossing,
a multi-family residential community with 288 multi-family residences spread throughout twelve (12) separate
buildings. Each building consists of six (6) 1-bedroom units, six (6) 3-bedroom units and twelve (12) 2-bedroom
units. The subject parcels are uniquely shaped infill parcels located at 4121 and 4114 Laster Lane in the
unincorporated county of Canyon, which is generally located east Lake Road, and north and west of the Notus
Canal.
2. ACTION ITEM: Public Hearing (Quasi-Judicial): Case Number ANN22-000026, CPM22-000011, ZON22-
000013, and SUB22-000043 (Midland Meadows Subdivision); A request by Mary Wall on behalf of Parkland
Development LLC., to annex Parcel 3411800000 (approximately 39.21 acres) with a proposed split zoning
designation of R-1 (Low Density Residential) on the portion north of Lincoln Road and R-2 (Medium Density
Residential) on the portion south of Lincoln Road, and a request for the rezone of Parcel R3411900000 from R-1
(Low Density Residential) to R-2 (Medium Density Residential, to include approval of a development agreement
associated with ANN22-000026 and ZON22-000013. Concurrently, the applicant is requesting a comprehensive
plan map amendment to add the north portion of Parcel R3411800000 (Approx. 17.9 acres) onto the City’s
comprehensive plan map area with a LDR (Low Density Residential) comprehensive plan future land use map
designation; and a comprehensive plan map amendment to change the future land use map designation of Parcel
R3411900000 and the south portion of R3411800000 from LDR (Low Density Residential) to MDR (Medium
Density Residential), to include Resolution 432-22 associated with CPM22-000011; and a request for the approval
of a preliminary plat for an approximately 80.71 acres development consisting of two-hundred and sixty-six (266)
residential lots and twenty-six (26) common lots for Midland Meadows Subdivision. Midland Meadows is
proposed to be developed in three (3) phases. The subject site is located on the NWC and SWC of Midland
Boulevard and Lincoln Road in Caldwell, Idaho.
3. ACTION ITEM: Public Hearing (Quasi-Judicial): Case Number: CPM22-000005/ ZON22-000008 / SUP22-
000019 / PUD22-000007 / SUB22-000027 / AMD-22-04: Mason & Associates, on behalf of North 44 Idaho LLC.,
is requesting approval of a Comprehensive Plan Amendment (CPM22-000005) on the subject parcel (R3284200000)
from HC (Highway Corridor) to a future land use designation of CS (Commercial & Service) along Hwy 55 on the
northern portion and a MDR (Medium Density Residential) future land use designation on the southern portion of
the subject parcel, to include approval of Resolution # 35-23. Concurrently, the applicant is requesting a rezone
(ZON22-000008) from R-1 (Low Density Residential) to a split zone of C-2 (Community Commercial) on the
northern portion and R-2 (Medium Density Residential) on the southern portion of the parcel, and approval for a
Planned Unit Development (PUD22-000007) and Preliminary Plat (SUB22-000027) for West Haven Subdivision,
a 55+ mixed-use community with commercial and residential housing options and amenities, to include approval to
amend an existing Development Agreement (DA-05-07) (AMD-22-04) to change the zoning, allow for commercial
development opportunities, allow for residential densities of 5.86 units per acre, and to add any additional conditions
specific to the new proposed development plan. Additionally, the applicant is requests a Special Use Permit
(SUP22-000019) to allow for an assisted living facility within the requested C-2 (Community Commercial) zone.
West Haven is proposed to be constructed in a single phase and will include 221 residential lots, two commercial
lots, and 26 common lots. The subject property is located at the southwest corner of Karcher Road and S. Florida
Avenue, parcel number R3284200000, Caldwell, Idaho. STAFF IS REQUESTING A CONTINUANCE UNTIL THE
NEXT REGULAR PLANNING AND ZONING COMMISSION MEETING TO BE HELD ON MAY 24, 2023 DUE TO
REVISED PLANS BEING NEEDED FROM THE APPLICANT TO ADDRESS SEVERAL OUTSTANDING ITEMS.
4. ACTION ITEM: Public Hearing (Quasi-Judicial): Case Number ANN22-000025, PUD22-000010, and SUB22-
000042 (Traverse Creek Subdivision); A request by Trilogy Development to annex parcel R3523600000 (approx.
45.93 acres) and R3411400000 (approx. 38.69 acres) with a requested zoning designation of R-1 (Low-Density
Residential), where the comprehensive plan land use designation is LDR (Low Density Residential), and approval of
a development agreement associated with ANN22-000025. Concurrently, the applicant is requesting approval of a
Planned Unit Development and Preliminary Plat for Traverse Creek, a single family attached and detached
subdivision, which is proposing 279 residential building lots with a density of 3.30 dwelling units per acre, and 54
common lots. The project will include a variety of community amenities including parks with grassy play areas, a
tot lot, picnic tables and benches, along with landscape buffers, a sport court, and pathways. The subdivision is
proposed to be developed in six (6) phases. The subject parcels are located on the SWC of Lincoln Road and Wells
Road; and the SWC of N KCID Rd and Marble Front Road, in Caldwell, Idaho.
5. ACTION ITEM: Public Hearing (Legislative): Case Number OA-23-01: A request by the City of Caldwell
Planning and Zoning Department to amend Chapter 10, Article 2, Section 10-02-13, Caldwell City Code, pertaining
to special events, by removing the restriction of special plaza events for triggering the authority of the plaza operator;
to amend Chapter 6, Article 5, Section 06-05-08, Caldwell City Code, pertaining to the location restriction for door
to door salesmen, by allowing operation within a parade route so long as a prior license has been obtained; to amend
Chapter 10, Article 2, Section 10-02-02, Caldwell City Code, pertaining to the land use schedule, by allowing certain
residential land uses within commercial zones with the approval of a Special Use Permit (SUP), by adding additional
language for mixed-use planned unit developments, by changing a medical, dentist office to a permitted use in the C-
1 zone, and by reformatting and cleaning up typographical errors in the table; and to amend Chapter 11, Article 2,
Section 11-02-02 (1) C (B) pertaining to the approved subdivision name on plats, by allowing for a formal procedure
to submit and obtain approval for a subdivision name change during the preliminary plat phase and/or after final plat
recordation. This ordinance would be in full force and effect from and after its passage, approval, and publication,
according to law; provides for severability; and repeals conflicting ordinances, resolutions, and orders.
VII. ADJOURNMENT
Public Information/Responsibility: For public hearing cases that are scheduled to be heard by City Hearing Bodies and are
not heard on the noticed date: The hearing body is required to provide a “date certain” for when that case will be heard
(typically on the next hearing agenda but not always). Additional notices are not required and are NOT sent to property
owners or posted on the site. Please check the city’s website for agendas and updates or contact staff for the hearing date that
the particular case is to be heard.
Next Regular Planning and Zoning Commission Meeting is on May 24, 2023. Any person needing special
