think if they are just code compliant, we are good with that.
the one thing that should be mentioned however, is that the city has indicated that the alley access on loth
may be closed off to full access with a raised median in the future. McDonald's is already aware of this but it
would hurt to remind them so there are no legal issues down the road regarding access.

Doug called and indicated that he feels a DA Modification would be the option to eliminate the trail of DA s. As Doug
indicated it does seem that the majority of the items in the DA s are memorialized in code and the development must
meet code to be completed -
Are there items that Engineering would prefer to have documented in a Development Agreement versus just leaving to
code compliance. Doug indicated that I will have to do a DA amendment regardless in order to Null and Void the DA's
that currently exist so it is no problem to include conditions in the amended DA process.
