V. vt. 1.1 TABLE OF CONTENTS: COURSE OF PROCEEDINGS GENERAL FACTS APPLICABLE LEGAL ANALYSTS TEST!MONY COMPREHENSIVE PLAN ANALYSIS RECOMMENDATION I COURSE OF PROCEEDTNGS The Caldwell Planning and Zoning Department issued a notice of Public Hearing on application OA-116-09, to be held before the Caldwell Planning and Zoning Commission on December 8, 2009. Public notice requirements set forth in ldiho Code, Chapter 65, Local Planning Act, have been met. On November 22,2009 notice was published in the ldaho Press Tribune. Notice was sent to all political subdivisions located within Caldwell's area of impact on November 13, 2009. 1.2 1.3 On December 8, 2009 the Planning and Zoning Commission recommended approval of the request to amend the city of caldwell Parks and Recreation Master plan. Files and exhibits relative to this application are available for review in the Caldwell Planning and Zoning Department,62l cleveland Blvd., as well at all public hearings. GENERAL FAGTS APPLICANT: Brian Billingsley, AICP, Caldwell Planning and Zoning Director, 621 Cleveland Blvd., Caldwell, lD 83605 REQUEST: This is a proposal by the Planning and Zoning Director to revise Caldwell's Parks and Recreation Master Plan and adopting the new version as "Appendix E" to the Caldwell Comprehensive Plan. BACKGROUND: The first Parks and Recreation Master Plan was adopted by the Caldwell City Council in 2000. This plan was updated in 2005. Due to rapid population growth since the adoption of 2005 plan, statf felt that the document needed to be revised. Page 1 of 5 I 2.1 2.2 2.3 OA-116-09 (Parks and Recreation Master Plan) RECOMMENDATION Rz-3 o o The new plan concentrates new park development in the southern and eastern portions of the city, where population growth is most prevalent. The new plan proposes improvements to our existing parks over the next ten (10) years. Staff conducted a public workshop in the Caldwell Police Station on June 8, 2009 to discuss the Plan with the general public. 2.4 OVERVIEW OF THE PI-AN: Chapter I is the introduction. This chapter explains the need for the Plan, the goals and objectives, and background information about our community. Chapter !l explains the existing conditions of our parks system. This section deals with public participation efforts, information on our existing parks and recreational services, and how our current parks system is being maintained. Chapter lll gives recommendations to improving our park system. This section outlines how much park land the City will need as our population grows, specific recommendations for improving our current parks, future sites of proposed parks, and improvements that should be made to our future park sites. Chapter lV establishes guidelines for new parks. There are four types of parks proposed in this Plan: a mini-park, neighborhood park, community park, and regional park. This chapter suggests design parameters and possible funding sources for these parks. Chapter V deals with the implementation of the plan. An implementation schedule containing proposed projects and estimates costs over the next ten (10) years is attached. The Commissioners discussed at length the location of the proposed parks, implementation schedule and impact fees with Mr. Billingsley. V COMPREHENSIVE PLAN ANALYSIS The Planning and Zoning Commission accepts the Comprehensive Plan components as listed below or modify if necessary. 5.1 CONSISTENT WITH THE COMPREHENSIVE PLAN: The request is consistent with the following components of the Comprehensive Plan: 5.1.1 Propertv RiEhts - GOAL: To ensure that land use policies, restrictions, conditions and fees do not violate property rights, adversely impact property values or create unnecessary technical limitations on the use of the property. OA-116-09 (Patus and Recreation Master Plan) RECOMMENDATION Page 2 of 5 I o OBJECTIVE A: To establish a sound basis for land use and environment regulations through comprehensive planning and adopted policies and ordinances. POLICY 1: Planning and zoning actions may be subject to a regulatory takings analysis provided in section -OZ-gOOg of the ldaho Code. Staff will follow the Attorney General's Checklist Criteria outlined in the ldaho Regulatory Taking Act Guidelines prior to initiating any proposed regulatory or administrative action on specific property, and to request legal counsel's review if any one of the criteria is answered in the affirmative. Staff reviewed the five criteria outlined in the Takings Act Guidelines and did not answer yes to any of the criteria. 5.1.2 School Facilities & Transportation - GOAL: To provide on-going opportunity for school representatives of Caldwell and Vallivue School Districts to participate in the community planning process. OBJECTIVE B: To ensure adequate school facilities and services that meet the educational, social, and recreational needs of the community. OBJECTIVE C: To optimize the public investment by providing the opportunity for the public to have use of educational facilities for recreational activities and/or social gatherings when school is not in session. 5.1.3 Land Use - GOAL l: To establish land-use management policies that protect property rights and the environment, maintain a high quality of life, provide adequate land for all types of development, and adequately buffer non-compatible uses. GOAL ll: To create a strong sense of community and place. GOAL lV: To create communities that accommodate cost effective public services and infrastructure. OBJECT]VES APPLICABLE TO ALL LAND USES: OBJECTIVE A: To guide the grovuth and development of land uses in such a way that the health, safety, and general welfare of residents will be protected. OBJECTIVES APPLICABLE TO THE AREA OF CITY IMPACT OBJECTIVE C: To periodically review patterns of growth as a part of long-range planning and to renegotiate new Area of City lmpact boundaries with Canyon County when growth patterns and capital facilities plans support the need for that action. OBJECTIVES APPLICABLE TO RESIDENTIAL LAND USE OBJECTIVE C: Consider use of the planned unit development (PUD) process under the following conditions: The land is physically constrained, preservation of open space, promotion of creative mixes of residential and commercial development and to accommodate unique and exceptional architectural design. Utilities. and Facilities - GOAL l: To ensure that there are adequate public services and infrastructure to meet the needs of the public. GOAL ll: To optimize the public investment in services and facilities. OBJECTIVE A: To provide for the orderly expansion of public services to meet the needs of population growth, and ensure that adequate infrastructure is in place to serve new development. OBJECTIVE C: To maintain adequate levels of public facilities and services that will serve the diverse needs of the city. POLICY 7: Analyze use of impact fees as a means of funding the costs of new development. Parks. Recreation. and Open Space - GOAL l: To develop and preserve parks, green belts, and recreational facilities to meet the diverse needs of a growing community. OBJECTIVE A: To provide increased recreationalfacilities and opportunities for all citizens. OBJECTIVE B: To establish parks and open space areas that will support new areas of residential growth. OBJECTTVE E: To follow guidelines for parks, recreational and open space development based on the National Recreation and Parks Association (NRPA) and the City of Caldwell Parks and Recreation Master Plan. POLICY 4: Develop a 10-year park and recreation plan that will meet the growing needs of the public. Acquire areas suiiable for parks, recreational sites and green belts in accordance with the Plan. POLICY 5: lncorporate pathways, ponds, and irrigation features into park designs' Communitv Desiqn - GOAL l: Foster growth in a manner that will enhance and improve the City's visual image. OBJECTIVE A: To promote, encourage and maintain an aesthetically pleasing city.
