HomeMy WebLinkAboutORD 3540ORDINANCE NO.3540 BILL NO.46 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL REPEALING AND REPLACING CHAPTER 2, ARTICLE 27, CALDWELL CITY CODE, PERTAINING TO THE CALDWELL EXECUTIVE AIRPORT ADVISORY BOARD; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. Chapter 2, Article 27 of the Caldwell City Code, is hereby repealed and replaced as follows: Article 27: CALDWELL EXECUTIVE AIRPORT ADVISORY BOARD: SECTION: 02-27-01: Creation and Composition 02-27-03: Membership; Appointment; Terms; and Vacancies 02-27-05: Duties and Responsibilities 02-27-07: Meetings 02-27-09: Officers 02-27-11: Records 02-27-01: CREATION AND COMPOSITION: An Airport Advisory Board is hereby created, consisting of up to nine (9) members, all of whom shall be appointed by the Mayor and approved by City Council. The members of the board shall serve without compensation. The term of office for each member shall be for a period of three (3) years. City of Caldwell's Director of Aviation will preside as the permanent Facilitator of the Board. Facilitator: The facilitator is responsible for the process of the meeting(s). This includes making sure that the ground rules are being followed, the agenda is being followed and the participants are engaged and on -task. 02-27-03: MEMBERSHIP; APPOINTMENT; TERMS; AND VACANCIES: Ord. 3540 -- Page 1 (1) Membership: The membership of the Advisory Board shall be composed of up to eight (8) additional members. Three (3) nominated members; one (1) Caldwell resident; and two (2) without regard to residency shall be Caldwell Executive Airport general aviation users that do not affiliate with a commercial entity on Caldwell Executive Airport. Three (3) nominated members; one (1) Caldwell resident; and two (2) without regard to residency shall be owner/operators of a commercial entity on Caldwell Executive Airport. One (1) member of the Council assigned as liaison to the Board, and one (1) youth Caldwell Resident, at the time of appointment, be greater than eighteen (18) and under twenty-one (2 1 ) years of age. Ex officio members consist of the Mayor, Airport Engineering representative and the City Attorney or his/her designee. Staggering terms should be implemented to ensure that no more than three (3) board member terms expire in any given year. No member shall serve more than three (3) full consecutive terms. Any member may be removed for cause by a majority vote of the city council. (2) Attendance: Missing two (2) or more permanently scheduled meetings by a board member without a valid excuse will be viewed as voluntary resignation from the board and that position will be filled in accordance with (02-27-03; paragraph (5)). (3) Removal: Unless expressly limited or prohibited by City or State Code, Board members may be removed at any time during their specified term by the Mayor with consent and approval of the City Council. The absence in City or State Code of provisions governing removal shall not constitute express limitation or prohibition. In the event State Code does provide an express prohibition or limitation on the ability to remove members of any Board, the City Council, by the adoption of this Chapter 2, Article 7, does intend to embrace all remaining and additional authority related to the removal of members not expressly governed by such State Code. (4) The youth member shall be appointed to a term of up to one year and may be reappointed for up to two (2) successive terms not to exceed a sitting time of three (3) years. If a vacancy shall occur during an unexpired term, the Mayor, with the consent of the Council, shall appoint a member to fill such unexpired term. 02-27-05: DUTIES AND RESPONSIBILITIES: It shall be the duty of the Board to provide recommendations to the City based on needs and impact analysis against an FAA approved Master Plan and Grant Assurances to assist in the orderly and efficient administration and operation of Caldwell Executive Airport: (1) To study the economic and physical conditions and problems in connection with the maintenance, operation, regulation, control and use of Caldwell Executive Airport; Ord. 3540 — Page 2 (2) To propose recommendations for the operation, control and use of Caldwell Executive Airport, and the maintenance and operation of hangars, repair shops, depots, taxi strips and all other facilities and utilities required, necessary or convenient for the proper orderly and efficient administration, operation, superintendence and control of the Caldwell Executive Airport; (3) To propose recommendations and suggestions for the purpose of planning for further growth, development and regulation of the Caldwell Executive Airport in order to promote the public interest, convenience and welfare in the administration and operation of the Caldwell Executive Airport, as well as to promote business activities to serve as a catalyst for economic development throughout the City and region; (4) All proposals for changes to current Airport Rules and Regulations and Minimum Standards proposed by the Board will be reviewed by the Board Facilitator, Chairperson and Vice -Chairperson to ensure FAA compliance. Reviewed proposals shall submitted to the City Council for approval and ratification and, after such approval and ratification shall have the force and effect of ordinance. (5) To advise the City of Caldwell's Aviation Administration in regards to rules and regulations for aircraft traffic regulation, airport facilities and runway improvements. (b) To formulate, propose and recommend such rules and regulations necessary or desirable to carry out the intent and purpose of this chapter. 02-27-07: MEETINGS: The Board shall schedule meetings once a quarter operating on Fiscal Year (FY) at a time and place to be determined by the Facilitator. Meeting schedule shall be submitted to the City Clerk No Later Than (NLT) 15 September of the preceding FY for recording and publication. Special meetings will be scheduled by the Facilitator or upon the request of any two (2) members when items need to be addressed outside of regularly scheduled meetings. All meetings shall be open to the public. 02-27-09: OFFICERS: Chairperson: The Chairperson is responsible for the meeting's outcomes and work product. Vice -Chairperson: The vice -chairperson stands in for the chair in his/her absence. The chairperson should liaise regularly with the vice -chairperson and ensure he or she knows enough about the current issues within the organization to be able to stand in at short notice. The Board shall elect a Chairperson, Vice -Chairperson and Recorder from appointed board members. The Chairperson, or in his/her absence the Vice Chairperson, in conjunction with the Facilitator, shall preside over all meetings of the Board. Ord. 3540 — Page 3 02-27-11: RECORDS: The Recorder (Board Facilitator) shall take written or media record of meeting proceedings and produce official minutes of said record within five (5) business days from meeting completion showing the discussion topics and outcome of each meeting and other official actions. Section 2. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. if any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 31 day of October, 2023. Section 1: Repeals and replaces Caldwell City Code Chapter 2, Article 27, pertaining to the Caldwell Executive Airport Advisory Board. Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3540 provides an effective date, which shall be on the 10`h day of October, 2023. Ordinance No. 3540 was passed by the Council and approved by the Mayor on the 3`d day of October, 2023.
