Dear Jarom,
As representative for Corey Barton Homes, please accept these applications for Administrative Review
and Petition to Vacate an Easement for Lot 31Block-3 within Canyon View Estates Subdivision,
otherwise known as the property located at 12667 Slatestone Way, Caldwell, ID or Parcel #R3282016900.
We have also completed/attached an Application for Release of Subdivision Plat Easement for Idaho
Power.
The purpose of our request is to reduce the western properly Interior Side Setback from six (61) feet to
four (4') feet due to accidental construction of the now complete Home that encroaches. Along with this,
we are also requesting to vacate the Public Utilities and Pressurized irrigation Easements as listed on
Notes #1 and #8 of the Final Plat also due to the encroachment.

working with you and your staff and would request approval of this request.

THE FOLLOWING LAND USE ACTION IS THE PRIMARY FEATURE OF THIS APPLICATION:
IN THE MATTER OF THE APPLICATION OF LANDMARK ENGINEERING & PLANNING INC. FOR
FINAL PLAT APPROVAL OF CANYON VIEW ESTATES SUBDIVISION, WHICH CONSISTS OF

1.1 On October 25. 2006, the Caldwell Community Development Department received the final
plat application on Case No. SUB-128F(1)-05.
1.2 Files and exhibits relative to this application will be available for review in the Community
Development Department, Caldwell City Hall, as well as all public hearings.
11 GENERAL FACTS
2.1 APPLICANT: Landmark Engineering & Planning Inc., 104 a Ave. South -Suite C, Nampa, ID
83651.
2.1.1 OWNER: Dave Holton, DH Development, LLC., 16299 Franklin Road Nampa, ID
2.2 LOCATION: The site is located approximately'!, mile east of the southeast intersectlon of lake
Avenue and Karcher Road.
2.3 REQUEST: The Applicant requests final subdivision plat approval for Canyon View Estates
Subdivision to develop seventy-two (72) residential and eight (8) common lots. The
subdivision is located in an R 1 (Single -Family Residential) zone.

2.4 BACKGROUND: Canyon View Estates Subdivision received preliminary plat approval from
the City Council on February 6, 2005.
2.5 PUBLIC FACILITIES:
2.5.1 PUBLIC SERVICES, UTILITIES, AND FACILITIES: In a memo dated November 20, 2006, the
Engineering Department submitted the following comments:
The Engineering Department has reviewed the proposed final plat for Canyon View Estates
and provides the following comments regarding the project and the submitted final plat:
1. The water system is operational. The water system has been constructed, pressure tested
and clean water samples have been received.
2. All weather surfaces are in place. Compaction test results for the roadways have been
submitted to the City for review and approved.
3. Street signs have been installed.
4. Sewer system is not operational. The on -site lines have been constructed, pressure tests
have been approved, and video has been received. This development drains into the
Fieldcrest Subdivision which has not fully completed their off -site utilities. The final plat will not
be signed, and no building permits will be issued until this emergency requirement is complete.
5. Construction security will have to be provided for those items not yet completed prior to
signing of the final plat. The city has not agreed on a bond amount for those improvements
not yet constructed.
6. The final plat drawing shall be corrected in accordance with the marked -up copy done
November 13, 2006 and mailed to Landmark Engineering on November 13, 2006.
7. In an effort to expedite the addressing process of the final plat, the City is asking that an
electronic copy, in AutoCAD format, be returned with the revised copy of the final plat.
2.5.2 CALDWELL FIRE DEPARTMENT: The Caldwell Fire Department was notified of this request
on October 25, 2006, no response was received.
2.6 CONSTRUCTION COMPLETION/FINANCIAL GUARANTEE: Subdivision Ordinance No.
2558 states that "the form of financial guarantee shall be submitted to the City Engineer within
thirty (30) days following the date of final plat approval by the City Council or approval of the
final plat may be null and void. At the discretion of the City Council, a thirty (30) day extension
may be granted. Upon submittal of the approved financial guarantee to the City Engineer, the
final plat, with all applicable signatures shall be released to the subdivider for recordation".
(Section 11-02-06(1)G).
2.6.1 By the time the 30-day time period for the financial guarantee to be in place arrives, the
estimate of costs for remaining construction will normally be substantially reduced from the
time the City Council first hears the final plat approval request. This allows the developer to
continue to work toward completing construction of the improvements concurrently with the
approval process.
