AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING THE
CALDWELL CITY CODE BY AMENDING CHAPTER 2, ARTICLE 15 CONCERNING PLANNING
AND ZONING COMMISSION; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR
SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho:
Section 1. Existing Chapter 2, Article 15 of the Caldwell City Code, concerning Planning and Zoning
Commission, is hereby revised as follows:
Section 02-15-01: COMMISSION INFORMATION:
(2) Membership: The Planning and Zoning Commission shall consist of not less than three (3) nor more than
twelve (12) seven 7 voting members, all appointed by the Mayor and confirmed by majority vote of the
City Council. An appointed member of the Commission must have resided in the County City for at least
two (2) years prior to his appointment and must remain a resident of the Gen# y City during his service on

purposes of determining whether a person meets the two (2) year residency requirements for service as a
member of the Planning and Zoning Commission the boundaries for the City and the area of Ci impact in
existence at the date of appointment shall be considered as having existed, unchanged, for the two years
preceding the date of appointment. The term of office for members shall not be more or less than three (3)
years, provided however, that at the expiration of said term of office, the member shall be eligible for two
additional consecutive reappointments each for one full term in addition to the original term already served.
No person shall serve more than two (2) full consecutive terms without specific concurrence by two-thirds
(2/3) of the Council adopted by_motion and recorded in the minutes. In no case shall any person serve more
than three (3) full consecutive terms. Vacancies occurring otherwise than through the expiration of terms
shall be filled in the same manner as the original appointment. Members may be removed for cause by a
majority vote of the geyerning Be City Council. Members shall be selected without respect to political
affiliation and may receive mileage and per diem compensation as provided by the City Council. in addition

(3) Organization: The Commission shall elect a Chairman Chairperson and create and fill any other office it
may deem necessary. The Commission may establish subcommittees, advisory committees or neighborhood
groups to advise and assist in carrying out responsibility under this Article and provision of the Idaho Code.
The Commission may appoint nonvoting, ex officio advisors as may be deemed necessary.
Section 2. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded
and annulled.
Section 3. This ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.

Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid
by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be
read to carry out the purposes of the ordinance before the declaration of partial invalidity.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.2776
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING SECTION 02-15-
01 OF THE CALDWELL CITY CODE CONCERNING PLANNING AND ZONING COMMISSION;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING
ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT
HEREWITH.
Section 1: Amends Section 02-15-01 of the Caldwell City Code as follows:
(1) Reduces maximum number of voting members from twelve to seven.
(2) Provides that members shall have resided in the City of Caldwell, prior to appointment, for at least two
years rather than Canyon County, excepting that one member may be from the City of Caldwell Impact
Area and that member shall have resided in the Impact Area for at least two years prior to appointment.
(3) Provides that all members must remain residents of the City of Caldwell for the duration of their terms,
excepting that the Impact Area member shall remain a resident of the Impact Area or of the City for the
duration of his/her term.
(4) Defines City and Impact Area boundaries, for purposes of the aforementioned two-year residency
requirements, to be those in existence at the time of appointment.
(5) Provides a maximum term limit of three terms with the requirement that the third and final term has to
be confirmed by City Council with a two-thirds majority vote.
(6) Removes the provision requiring two members of City Council as ex officio members of the
Commission.
(7) Changes the word "chairman" to "chairperson".
Section 2: Repeals conflicting ordinances, resolutions and orders.
Section 3: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and
publication, according to law.
Section 4: Provides for severability.
Ordinance No. 2776 provides an effective date, which shall be when published in the Idaho Press Tribune on the
22"d day of December 2008. Ordinance No. 2776 was passed by the Council and approved by the Mayor on the
151h day of December 2008. The full text of the Ordinance is available at Caldwell Planning and Zoning, 621
Cleveland Boulevard, Caldwell, Idaho, The Mayor and City Council approved the foregoing summary on the
15`h day of December 2008 for publication on the 22"d day of December 2008, pursuant to Idaho Code 63-215.
