AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND
THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS
PART OF THE M-1 (LlcHT INDUSTRIAL) ZONE DISTRICT; AND DECLARING SAID LANDS
BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY
OF CALDWELL, GANYON GOUNTY, IDAHO; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE GITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD
SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A GERTIFIED COPY OF
THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY,
STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO
coDE, sEcTtoN 63-2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and
Zoning Commission, and following the public set forth in
10-01-07, Zoning Ordinance No. 1451, approved
a public hearing held January 7 ,2002.
Section 2. The property abuts the northeast side of Cleveland Boulevard approximately 1250
feet southeast of the intersection of Happy Day Boulevard and Cleveland Boulevard (more
commonly known as 6521 E. Cleveland Blvd. The parcel is contiguous to the City of Caldwell,
ldaho and the applicant has requested that said following described property should be annexed
into the City of Caldwell as an M-1 (Light lndustrial) zone:

Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage,
approval and publication, according to law.
Section 6. The Clerk of the City of Caldwell, ldaho shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman-like manner plainly and clearly designating the boundaries of the City of Caldwell,
including the land herein annexed, with the following officials of the County of Canyon, State of
ldaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a
certified copy of this ordinance with the State Tax Commission of the State of ldaho, all in
compliance with ldaho Code 63-2219.

During August of 2009, Dillon Caldwell, LLC applied to and received from Canyon
Counfi uriron"to M2 of property they had contracted to buy. This property,
#R30926010, is in Cu"yo" Co.r"ty and adjoins the subject lroperty' ft: t"!l:"t property
consists of 5 parcels #'s R:0908, iu09l9, RrOqzo, R3091901I and R3019010 and is
zoned Ml. The rezone process of the County property included a request to the City of
Caldwell for their comments. The City's .".ponti dated August 17,200-9'-states' "It
appears in the request that the currently-exisiing business to the west will be expanding
its business to the suU;ect property, therefore -ut ing a portion of the business in City of
Caldwell and a portion of the busi.ress in Canyon Courrty. It is the City's opinion that the
same business, operating on contiguous pieces of property, is better served by being
either completely within the City o, "o-pl"t"fy *itfti"g,L County - not a combination of
both.,, In November otp neighbtrs to the wesiasked if we were interested in purchasing
their property. Prior to meetlng with them on November 10, 2009,I phoned Brian
Billingsi, P&ZDirector, and Jonfirmed the City's preference that we be totally within
one entity.
I agree that this would be best for all concemed. At present, the County isthe best fit'
Ori operation is more rural/industrial in nature. We currently requirg ry citf water or
sewer services and there is nothing in our long range plan which could require these
services. Our 25 acres are mostly storage with an acre to employee ratio of
approximately 3: I . I am .rrru**" of an! fire, police, ambulance or other emergency city
services ever being required.
The remaining portion of parcel #R30926010 will continue to be owned by the Al Russell
Family, Lp ana pa Bollinger. They agree with the City of Caldwell and Dillon Caldwell'
LLC,'thata same business-operating o-n contiguous parcels, have all parcels in the City or
County. Their representativl, errow Land Surveying, Inc., sent a leffer to the- City of
Caldwell dated July 15, 2009 informing the City of their intentions to have this property
annexed into the CitY of Caldwell.

The City limit line currently runs through a corrmercial area cutting across multiple
buitdings. Our client wishes to clean up this area by doing an annexation in the City of
