ARTICLE 2 (SECTION 10-02-13) OF THE CALDWELL CITY CODE, REMOVING DUPLICATIVE PROVISIONS
RELATED TO BUSINESS PERMITS; AND AMENDING CHAPTER 10,ARTICLE 2 BY ADDING A NEW SECTION
ENTITLED 10-02-16 CONTAINING PROVISIONS RELATED TO THE REGULATION OF BUSINESS PERMITS FOR
THE CITY OF CALDWELL)
Katie Phillips,Associate Planner at 621 Cleveland Boulevard,presented the staff report read the following into the record:
1. City Code currently requires a business permit. Staff is requesting the renewal process of the existing permit. Currently,staff
only knows when a business has moved or gone out of business and a new business applies for a permit at the location.
2. Having a renewal will provide emergency and development services staff as a notification of any changes to the business,
hazards or issues that need to be addressed.
3. Home Occupation Permits and Mobile Food Unit Permits currently require an annual renewal.
4. In preparing this ordinance,staff reached out to neighboring cities for their requirements. The cities of Meridian,Kuna,Boise,
Emmett as well as Canyon County require a business license and renewal.
5. The renewal method is intended to be an easy process for the business owner and staff through the online portal.
6. The permit shall be renewed annually--one year from the date the permit is issued.
7. The fee for the initial permit is$100 and the renewal fee is$25. These fees will cover staff time and the application review
process.
8. Staff will be able to identify what businesses are in Caldwell for tracking purposes.
9. At some point in the future,staff would like to provide a business directory to the public, the business community and any other
interested parties.
Ms. Phillips noted that the Planning and Zoning Commission expressed concern at their public hearing with the
"Violation" portion of the ordinance and recommended approval with a change to that section. In response,the
City Attorney added language to clarify when a fine would be assessed.
Councilman Callsen asked about the absence of information relating to the Caldwell Fire Department and the Caldwell Police
Department in the proposed document.
Councilman Wagoner asked if contact was made with the local business owners about the proposed ordinance. What is the
percentage of businesses that currently hold a business permit?
Councilman McGee asked if the ordinance would also include the Home Occupation License process.
Ms. Phillips reported that officials from the Caldwell Fire Department and the Caldwell Police Department would be included
within the permit approval process.The Home Occupation process is addressed within a separate section of the Planning&Zoning
Ordinance. Contact has not been made with the local business owners regarding the ordinance. Research was not conducted
regarding the number of businesses that currently hold a business permit.
In response to questions from Councilman Allgood,Ms.Phillips clarified that the fee was appropriated within the FY-2021 budget.
Cheryl Tunno,Director of the Caldwell Chamber of Commerce at 1001 Blaine Street, asked that the public hearing be continued
for allow feedback concerning the proposed ordinance from the Chamber of Commerce business members.
Councilman Hopper recommended that a plan be put in place to inform the business owners of the renewal process.

MOVED by Wagoner,SECONDED-fry McGee to continue the public hearing to the Regularly Scheduled City Council Meeting to
be held on April 4, 2021 at 7:00 p.m. allowing time for staff to provide additional information per discussion within the public
testimony portion of the hearing.
