ORDINANCE NO. 3460
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO C-2 COMMUNITY COMMERCIAL AND R-2 MEDIUM DENSITY RESIDENTIAL ZONES;
DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE -CITY OF
CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission
and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal
Code, approved Case No. ZON22-000008 (West Haven Subdivision) at a public hearing held this 51h day
of September, 2023.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned as C-2 (Community Commercial) and R-2 (Medium Density
Residential) zones:
C-2 ZONE
A parcel of land being a portion of the NE % NW % of Section 14, T3N, R3W, BM, Canyon County Idaho,
more particularly described as follows:
BEGINNING at the NE corner of the NE % NW %; thence S00135'07"W, 378.05 feet along the east
boundary of said NE'/ NW %; thence S89041'44"W, 1325.64 feet parallel with the north boundary of said
NE % NW % to a point on the west boundary of said NE % NW %; thence N00136'27"E, 378.05 feet along
said west boundary of the NE % NW % to the northwest corner of said NE'/AW %; thence N89141'44"E,
1325.49 feet along said north boundary of the NE % NW % to the POINT OF BEGINNING. _Containing
11.50 acres, more or less.
R-2 ZONE
A parcel of land being a portion of the NE % NW % of Section 14, T3N, R3W, BM, Canyon County Idaho,
more particularly described as follows:
COMMENCING at the NE corner of the NE '/4 NW %; thence S001135'07"W, 378.05 feet along the east
boundary of said NE'/4 NW Y4 to the POINT OF BEGINNING; thence S00035'07"W, 559.99 feet along the
east boundary of said NE % NW %; thence S89°39'14"W, 158.00 feet parallel with the south boundary of
said NE'/ NW'/; thence S00°35'07"W, 115.00 feet parallel with said east boundary of the NE % NW %;
thence S89039'14"W, 195.00 feet parallel with said south boundary; of the NE '/4 NW %; thence
S00°35'07"W, 270.50 feet parallel with said east boundary of the NE % NW % to a point on said south
boundary of the NE % NW %; thence S89°39'14"W, 973.02 feet along said south boundary of the NE
NW'/4 to the SW corner of said NE % NW'/4; thence N00036'27"E, 946.45 feet along the west boundary of
said NE Y NW %; thence N89°41'44"E, 1325.64 feet parallel with the north boundary of said NE Y NW Y4
to the POINT OF BEGINNING. Contains 26.18, acres more or less.
Section.3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are .
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as Commercial.
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3460
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3460 was passed by the Council and approved by the Mayor on the 51h day of
September, 2023. The full text of the Ordinance is available at Caldwell City Hall, 411 Blaine
Street, Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing summary on
the 5th day of September, 2023, for publication on the 26th day of September 2023, pursuant to
Idaho Code § 50-901A.

A parcel of land being a portion of the NE 1/4 NW 1/4 of Section 14, T3N, R3 W, BM, Canyon
County Idaho, more particularly described as follows:
