Attached please find a letter that was sent to Christi S. Vernon, Business
Administrator for the Our Lady of the Valley church.
As you may be aware, the Our Lady of the Valley recently built a new religious
facility located at the intersection of Linden Street and Farmway Road. The
church would like to install signage on the property to identify the church
building(s) by name and to provide official notices associated with church-related
activities. The church is located in a single-family zone which does not allow for
this type of signage. However, our Caldwell Zoning Ordinance does have a
provision that if the sign is intended primarily for purposes of official notices, it
can be installed on public property regardless of the fact that the underlying zone
is residential.
Accordingly, I have provided an administrative determination that would allow this
information sign on the church premises for information purposes only. This
administrative determination is subject to appeal and thus the need to notify you.
!f you have concerns about the church having this opportunity, please contact our
office at 455-3021. Any appeal to this determination must be submitted to the
Caldwell Planning & Zoning Department within 10 days following the date of
notification.

Subject: Placement of a monument sign associated with Our Lady of the Valley Catholic
Church at the intersection of Linden Street and Farmway Road.
Dear Ms. Vernon
This letter is in response to your letter received, requesting administrative relief from the
City's zoning sign stricture that prohibits the placement of a sign in a single-family
residential zone except in certain circumstances.
ln your correspondence you note that there is an exception in the zoning ordinance,
known as footnote one, that may afford the placement of a monument sign in single-
family zone to denote the name of the building, date of erection, commemorative tablets,
official notices, flags and similar types of signs.
What I gather, from your request, is that the Valley Catholic Community Church
leadership is seeking to install a freestanding, internally-illuminated monument sign at
the corner of Farmway Road and Linden Street and relying on that zoning exception to
place it there.
Normally, an information sign such as you have described would not be permitted in a
single-family residential zone and noting that is the church site's zoning designation. The
reason it would not be allowed there is because the Caldwell Zoning ordinance is very
restrictive about the placement of signage in that zone.
lf the primary purpose of this information board is to identify the church building(s) by
name and to provide official notices associated with church related activities, then I
believe it may be installed on the church ground, even though the zoning is residential
and relying upon that footnote for this determination. ! want to qualify that the message
content (on the message board) shall be limited to that of a church related nature as
opposed to serving a commercial interest (for profit).
Therefore, this determination administratively approves the placement of a monument
sign on church property at the intersection of Farmway Road and Linden Street,
provided its placement is outside the vision triangle and consistent with the submitted
sign plan.

Assuming that this is a correct interpretation of the zoning ordinance, the church
leadership will need to acquire a sign and a building permit for the installation of this
monument sign. Accordingly, the sign will have to be structurally designed to meet the
building and engineering department's code requirements. As part of the permitting
process, Community Development staff will review the sign's placement to ensure the
location is consistent with good planning principles and practices.
Because the provisions of the zoning ordinance caution against the placement of
illuminated signage in the residential zone, this determination is conditional upon the
limiting of the monument sign's hours of illumination to the time period 7:00 A.M. to
10:00 P.M. through some acceptable timing device.
ln the event that these hours of illumination cause the neighbor's concern, then it is
understood that these hours may be further modified to find some level of compromise
between the needs of the church and the nearby neighbors.
I want to qualify that this determination is limited to a church related use. Should the
church sell or lease this land for some non-church related purpose, this administrative
determination shall divest.
I also want to qualify that this is an administrative determination and thus subject to
appeal.
It is my intent to mail this letter to all property owners residing within 300 feet of the
school site to advise them of this determination and the opportunity to appeal it to the
Caldwell Planning and Zoning Commission.
Accordingly, if any citizen with standing is aggrieved by this determination (including
church representatives), they may appeal it to the Caldwell Planning and Zoning
Commission, provided the written notice of appeal is filed with the Community
Development Department, located at62l Cleveland Boulevard within ten (10) days of
the mailing date.
Therefore, absent a timely appeal of this administrative determination, representatives
from the Valley Catholic Community Church may proceed to install this monument sign
on the aforementioned church site and according to the terms of this letter.
