3. Speak to the point...Public officials have heard hundreds of people give testimony.They are grateful when the testimony is
pertinent,well organized,and directly regards the matter at hand.Long stories,lectures or philosophy,abstract complaints
about generalities,or redundant testimony are usually a poor use of time.
4. State your recommendation.
5. Be informed....Get a copy of the plan being heard,the staff report,the proposed ordinance,or other pertinent material.Then
read it and plan your comments accordingly.
6. If you don't wish to speak,write it down...and submit it prior to the hearing.If written testimony is specific,to the point and
concise,it will be given as much attention as oral testimony.

I. Call to Order- Hearing Examiner, Mr.Jerome Mapp,opened the meeting for the public
hearing at 7:07 p.m.
II. Review of Proceedings- Mr.Jerome Mapp outlined the procedures for the public hearing.
Members Present: Brian Billingsley(Planning Director);Jarom Wagoner(Senior
Planner/Development Team Leader); Robb MacDonald(City Engineer); Lori Colligan
(Administrative Secretary)

III. Mr.Mapp approved the Minutes of the September 11, 2018 meeting as previously signed by
Hearing Examiner Mapp.
IV. New Business:
1. Case Number SUP-18-15:A request by Jay Multanen for a special-use permit to
operate an Event Center within the C-C (City Center) Zone. The subject property is
located at 815 Arthur Street(Parcel R0458700000)in Caldwell, Idaho.
Testimony:
Jarom Wagoner,Senior Planner, 621 Cleveland Blvd., Caldwell, ID 83605, presented the staff
report and stated that the applicant is requesting special use permit approval to operate an
event center within the City Center zoning district. The applicant intends to use the
building to house a public restaurant with a commercial kitchen and use the ballroom for
event space to serve private business and community events. The applicant indicates that
they plan to hold small ticketed events such as concerts but that will not be the primary
purpose of the event center space.The subject property is located at 815 Arthur Street.
Staff feels this would be a great addition to the downtown area. There are conditions staff
has recommended. Any renovations to the building would need to go to the Design Review
Commission.
Mr. Mapp asked about parking.
Mr.Wagoner stated that the downtown area is the only zone where you can count street
parking spaces towards the required total. Within 800 feet of this site there are hundreds of
parking spots.

Jay Multanen, 723 Garbff Street, Caldwell, Idaho stated that it haven 8 years since he
moved his family business from Boise to Caldwell. Since he has been here he has wanted to
give back to the community. Providing a gathering space is one way he can do that. In
addition,the Eagle's served meals in this building.There is a wonderful space for a
restaurant. He has spent some time downtown meeting with people and there is ample
parking downtown.
Mr. Mapp asked if he agreed with the conditions in the staff report.
Mr. Multanen said yes. He plans to bring this building to code.

use permit to construct and operate a traditional mini-storage facility within the C-3

Testimony:

report and stated that the applicant is requesting special use permit to construct a
traditional mini-storage facility to include RV/Vehicle Storage. This property is located in
the APO 1 zone which restricts residential and allows commercial. Staff recommends street
and landscaping improvements.
Mr. Mapp asked if there will be landscaping required on the right side of the property.
Mr.Wagoner said yes, a buffer will be required to separate the uses.
Mr.Mapp asked if they discussed materials.
Mr.Wagoner said no,they have not yet discussed that.Condition 8.3 discusses this.

Mr.Jeff Hatch, 6126 W State St. Boise, ID representing the applicant. Mr. Hatch indicated
they had a couple questions at the neighborhood meeting regarding landscaping. They also
had some concerns about views and preferred open lot storage towards the east. There is a
large existing irrigation canal that they are proposing to maintain and that creates a buffer
to the neighbors to the East. Regarding the materials,they have started investigating and
they are proposing a pre-engineered metal facility with an office that has a storefront that
fronts Middleton Road. They would feature a front facade with masonry that creates
columns every so often.
Mr. Mapp asked if there were living quarters or just an office.
Mr. Hatch replied there would be no living quarters.
Mr. Mapp asked about the entrance and how it would be controlled.
Mr. Hatch said on the western end there would be a single access point.
Mr. Mapp asked about lighting on site.
Mr. Hatch hasn't been asked any specifics.
Mr. Mapp stated lighting should not be facing neighbors. He also asked what type of surface.
Mr. Hatch replied asphalt.
Mr. Mapp asked about conditions-there shall be no outdoor storage or businesses on site.
Mr. Hatch said he reviewed the conditions and is in agreement. The owner intends to have
security as well as on site staff.

Testimony:

applicant is requesting to annex 18.5 acres,more or less,with an R-1 (Low Density
Residential) zoning designation with a Development Agreement. Property has frontage on
Marble Front Road to the south and Lincoln Road to the north. The Comprehensive Plan
Map designates this area as low density residential.
Mr. Mapp asked about condition 8.10 and the approval of Southwest District Health. What
happens when sewer becomes available.
Mr. MacDonald stated because this is not a subdivision it falls under the infrastructure
policy and basically what that states is that if sewer is not available then they are eligible for
a septic system. City Code reads that once sewer is available you have approximately a year
to connect. It is very difficult to enforce this. It usually happens when the septic system
fails.
Mr. Mapp asked if that would be in the Development Agreement.
Mr. MacDonald said yes,they could add that to the Development Agreement.
Mr.Jay Walker,849 E State St. Eagle, Idaho testified that he represents the applicant and
seeks approval of annexation to create three estate lots of 5.27 acres and one estate lot of
1.19 acres for family members and preservation of this fast growing area. This request is
consistent with the City Comp Plan. They had a successful neighborhood meeting.The only
concern was that irrigation be maintained and a 10 ft easement along the property
boundary be shared with the neighbor.
Mr. Mapp asked Mr.Wagoner what happens in 20 years if any of the property owners
decide they do not want to continue the use and want to split lots.
Mr.Wagoner stated they would just have to comply with city code.
Mr. Mapp asked the applicant about the private drive and how it will be maintained.
Mr.Walker stated they will do a shared maintenance access agreement.

subject property is located at the southeast corner of Aviation Way and Skyway Avenue

Testimony:

report and stated that the applicant is requesting to rezone approximately 5.56 acres,more
or less,from C-4 (Highway Commercial) to M-1 (Light Industrial). Staff does find this
request to be compliant with the Comprehensive Plan. Staff has recommended conditions.
Mr. Mike Kane, 19212 Gold Finch Way, Caldwell, ID (applicant) is the owner of Cold Steel
Properties. He is in agreement with the conditions.
Mr. Mapp asked for a little background on his request.
They started the Cold Steel business in 2016. They purchased a 2 acre lot in the Sky Ranch
Subdivision and then constructed a 22,000 sq foot shop and office. They have 32
employees. Then they found they needed to expand. He was interested in this parcel for
future development and they would keep the other facility.They install food processing
equipment all over the country. Future site is to establish a presence for food processors in
the area.

I COURSE OF PROCEEDINGS
1.1 The Caldwell Planning and Zoning Department issued a notice of Public Hearing on application SUP-
18-14 to be held on November 13, 2018. Public notice requirements set forth in Idaho Code,
Chapter 65, Local Planning Act,were met. On,or before,October 28,2018,notice was published in
the Idaho Press Tribune, and on, or before, October 26, 2018 notice was mailed to all political
subdivisions providing services to the site and to all property owners within 300 feet of the project
site; and on, or before, November 1, 2018 notice was posted on the site.
1.2 On November 13, 2018 the Caldwell Hearing Examiner approved the request.
1.3 Files and exhibits relative to this application are available for review in the Planning and Zoning
Department,621 Cleveland Boulevard,Caldwell and at applicable public hearings.
II GENERAL FACTS
2.1 APPLICANT:Jeff Hatch, Hatch Design, 6126 W.State Street Suite 107, Boise, Idaho, 83703.
2.2 REQUEST: The applicant is requesting special use permit approval to construct a traditional mini-
storage facility to include RV/Vehicle storage.
2.3 COMPREHENSIVE PLAN DESIGNATION:The Caldwell Comprehensive Plan Map designation for the
site is Commercial.
Service Commercial- Suitable for a wide range of retail and service uses including more intense
commercial uses such as those that require large amounts of land for sales,storage or parking,light
production or repair of consumer goods, and which may be less compatible with residential uses
due to traffic,noise and other impacts.

Land Use: The subject property is zoned C-3 (Service Commercial) and is surrounded by the

2.4 Transportation/Connectivity: The subject property has frontage onto Ustick Road and Middleton
Road,both principal arterial roadways.
2.5 Public Services, Utilities and Facilities: The engineering department, fire marshal, building
department,and police department were all sent a request for comment on October 16, 2018.
2.6 Landscaping: As per Section 10-07-02(2) of City Code, landscaping should be required for this
project. City Code requires a 25-foot wide grass landscape buffer along Ustick and Middleton Road.
The applicant should be required to provide 1 Class II tree for every 35 feet of linear frontage and
1 shrub for every 7 linear feet of frontage. The applicant should be required to install landscaping
abutting the area under construction/development,rather than the entire site.

VI FINDINGS OF FACT
6.1 The Caldwell Hearing Examiner accepts the facts outlined in the staff report, public testimony and
the evidence list. All adopted city ordinances, standards and codes were used in evaluating the
application. The proposed use is conditionally permitted by the terms of the ordinance and is
subject to conditions of approval.
VII CONCLUSIONS OF LAW
7.1 The Caldwell Hearing Examiner has the authority to hear this case and order that it be approved or
denied. The public notice requirements were met and the hearing was conducted within the
guidelines of applicable Idaho Code and City ordinances.
VIII ORDER OF DECISION
8.1 Based on the Findings of Fact and Conclusions of Law,the Caldwell Hearing Examiner hereby orders
that Case Number SUP-18-14 a request by Jeff Hatch and Ustick Mini-Storage for a special-use
permit to construct and operate a traditional mini-storage facility within the C-3 (Service
Commercial) Zone for the property located at the southeast corner of Middleton Road and Ustick
Road (Parcel R3087700000) in Caldwell, Idaho, is approved with the following conditions of
approval:
8.2 Comply with the all applicable city codes,ordinances,policies,and standards.
8.3 The development,design,and construction of the proposed storage facilities shall be in substantial
compliance with the submitted site plan (See Exhibit A-3) and landscape plan (see Exhibit A-8) of
Case File SUP-18-14. Any substantial deviations,as determined by the Planning&Zoning Director,
from said Case File Exhibit,shall require Hearing Examiner approval,through a public hearing.
8.4 Install a minimum 25-foot wide landscape buffer along Ustick Road, abutting that portion of the
site being developed. The buffer shall contain a minimum of 1 Class II tree for every 35 feet of
frontage and 1 shrub for every 7 feet of frontage, along with sod turf grass ground cover. All
landscaping must be maintained in a living and weed-free condition.
8.5 Comply with the requirements of all applicable agencies, including but not limited to Pioneer
Irrigation District, City of Caldwell Engineering Department,City of Caldwell Fire Department,and
Canyon Highway District No.4.
8.6 All accesses,drive aisles,and parking areas shall be paved or concrete.
8.7 All requirements from the Fire Department for access, turnarounds, emergency access, water
supply, fire hydrants, etc.shall be met in the development of the subject property. Final approval

of the location and number of fire hydrants within the development shall be determined by the Fire
Marshal.
8.8 There shall be no storage of hazardous materials on the site.
8.9 There shall be no auto repair taking place on the site,whether for commercial and/or private use.
8.10 No other business activity shall occur on site,other than for the storage facility itself.
8.11 No outdoor storage other than what has been approved.
8.12 All drainage shall be retained on-site.
8.13 all outdoor lighting shall be directed away from surrounding properties.
Case Number SUP-18-14 was heard by the Caldwell Hearing Examiner at a public hearing held November
13, 2018.
The Findings of Fact,Conclusions of Law,and Order of Decision were administratively approved and
signed by the Caldwell Hearing Examiner on the date noted below.
