ORDER OF DECISION COURSE OF PROCEEDINGS 1.1 The Caldwell Planning and Zoning Department issued a notice of Public Hearing on application DAN-184-10 to be held before the Caldwell City Council on November 15, 2010. Public notice requirements set forth in Idaho Code, Chapter 65, Local Planning Act, were met. On October 31, 2010 notice was published in the Idaho Press Tribune; on October 29, 2010 notice was mailed to all property owners within 300 feet of the project site and to all political subdivisions providing services to the site; and, on November 4, 2010 notice was posted on the site. 1.2 Files and exhibits relative to this application are available for review in the Planning and Zoning Department, 621 Cleveland, Caldwell, and at the applicable public hearings. The owner/applicant would like the property to revert to Canyon County zoning to thus allow for using the property for horses and rural, agricultural uses. 2.4 BACKGROUND: The subject property was annexed into the City of Caldwell in 2007 by the previous property owner who was Sallie Palleria. Sallie Palleria (who is now Sallie Bradshaw) no longer retains ownership of the property. The property is now owned by Michael Breshears and Angela Coleman, the applicants of the de -annexation request. You are being notified because Idaho Code, 67-6509, Local Planning Act 67- 6509, requires notice of this public hearing to be provided to all political subdivisions providing services to the site and to all property owners or purchasers of record who own property within 300 feet of the subject area. Correspondence regarding the proposal is to be submitted to the Planning ,& Zoning Department no later than five (5) working days prior to the public hearing. Public testimony will be taken at the hearing and made a part of the record. Case files and exhibits relative to this request are on file at the Caldwell Planning & Zoning Department and are available for review during the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday.
