ORDINANCE NO. 3463
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
REZONED TO THE H-C (HIGHWAY CORRIDOR) ZONE; DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission) and following the public notice and hearing procedures as required in Section 10-03-03,
Caldwell Municipal Code, approved Case No. ZON22-000007 (Valencia Village) at a public hearing held
this 5M day of September, 2022.
Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said
following described property should be rezoned to H-C (Highway Corridor) zone:
A parcel of land located in the S '/ NW '/ of Section 29, T4N, R2W, BM, Canyon County, Idaho, more
particularly described as follows:
COMMENCING at the Section corner common to Sections 19, 20, 29 and 30, T4N, R2W, BM from which
the % corner common to said Sections 20 and 29 bears N89°50'38"E, 2640.70 feet; thence S00013'16"E,
1327.63 feet to the N 1/16 corner common to said Sections 29 and 30; thence S00010'48"E, 1177.51 feet
on the west boundary line of said Section 29 to a line parallel with and 150.00 feet north of the east -west
centerline of said Section 29 and the POINT OF BEGINNING; thence N89°47'07"E, 1567.18 feet on said
parallel line to the centerline of the Mason Creek Drain; thence S21°10'21"E, 160.63 feet on said centerline
of the Mason Creek Drain to the east -west centerline of said Section 29; thence S89°47'07"W, 1624.73 feet
on said east -west centerline to the % corner common to said Sections 29 and 30; thence N00°10'48"W,
150.00 feet on the west boundary line of said Section 29 to the POINT OF BEGINNING. Contains 5.496
acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as H-C (Highway Corridor).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3463
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
Ordinance No. 3463 was passed by the Council and approved by the Mayor on the '9h day of September
2023. The full text of the Ordinance is available at Caldwell City Nall, 411 Blaine Street, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 5th day of September 2023,
for publication on the 121h day of September, 2023, pursuant to Idaho Code § 50-901A.
A parcel of land located in the S Yz NW '/4 of Section 29, T4N, R2W, BM, Canyon County, Idaho, more
particularly described as follows:
COMMENCING at the Section corner common to Sections 19, 20, 29 and 30, T4N, R2W, BM from which
the'/+ corner common to said Sections 20 and 29 bears N89°50'38"E, 2640.70 feet; thence S00013'16"E,
1327.63 feet to the N 1116 corner common to said Sections 29 and 30; thence 300010'48"E, 1177.51 feet
on the west boundary line of said Section 29 to a line parallel with and 150.00 feet north of the east -west
centerline of said Section 29 and the POINT OF BEGINNING; thence N89047'07"E, 1567.18 feet on said
parallel line to the centerline of the Mason Creek Drain; thence S21 *10'21 "E, 160.63 feet on said centerline

acres, more or less.
The Ordinance includes a provision to amend the official maps of the City by designating the above -
described property as H-C and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 101h day of September, 2023. Ordinance No. 3458 was passed by the Council and
approved by the Mayor on the 5th day of September, 2023. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the foregoing
summary for publication pursuant to Idaho Code 50-901 A on the 51h day of September, 2023.
