If you have a cough, fever, or are not feeling well, please contact the City Clerk’s Office or Planning & Zoning Department (land-use public hearings) to arrange participation remotely. The City of Caldwell follows the CDC guidelines to allow for distancing in the public meeting area and provide masks/hand sanitizer on site. Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During the registration process, you will be asked what item on the agenda you wish to speak about. Please use the case number as listed within the written notice. On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public meetings” button on the center of the page. After registration, you will receive a confirmation email containing information about joining the virtual meeting. CONSENT CALENDAR: [ALL CONSENT CALENDAR ITEMS ARE ACTION ITEMS] 1. The Caldwell City Council dispenses with the three (3) reading rule of Idaho Code §50-902 for all ordinances. 2. Approve minutes for the Regularly Scheduled Caldwell City Council meeting held on August 1, 2023 and the Traffic Commission meeting held on August 2, 2023; 3. Approve Findings of Fact, Conclusions of Law, and Order of Decision for Case Number(s): SUB23-000018-FP: Jason Ramsey, on behalf of 10th Avenue Heights LLC, is requesting a final plat application for 10th Avenue Heights Subdivision, a ten (10) lot subdivision with nine (9) multifamily residential lots and one (1) common lot that consist of eight fourplex buildings and one duplex building. The original preliminary plat (SUB-20P-10) was approved by City Council on March 15, 2021. The plat has had two preliminary plat time extensions to allow time to complete the necessary infrastructure and they are now applying for approvals so they may record their final plat. The subject property address is 0 10th Avenue Heights, parcel R3566400000, and is physically located approximately 150 feet south of the intersection between South 10th Ave. and Amber St., on the west side of Amber St., in Caldwell, Idaho. Approve Findings of Fact, Conclusions of Law, and Order of Decision for the Denial of Case Number: ANN22-000026 / CPM22-000011 / ZON22-000013 / SUB22-000043: City Council moved to deny all applications on August 1, 2023. A request by Breckon Land Design on behalf of Parkland Development LLC., to annex Parcel 3411800000 (approximately 39.21 acres) with a proposed split zoning designation of R-1 (Low Density Residential) on the portion north of Lincoln Road and R-2 (Medium Density Residential) on the portion south of Lincoln Road, and a request for the rezone of Parcel R3411900000 from R-1 (Low Density Residential) to R-2 (Medium Density Residential, to include approval of a development agreement associated with ANN22-000026 and ZON22-000013. Concurrently, the applicant is requesting a comprehensive plan map amendment to add the north portion of Parcel R3411800000 (Approx. 17.9 acres) onto the City’s comprehensive plan map area with a LDR (Low Density Residential) comprehensive plan future land use map designation; and a comprehensive plan map amendment to change the future land use map designation of Parcel R3411900000 and the south portion of R3411800000 from LDR (Low Density Residential) to MDR (Medium Density Residential), to include Resolution 432-22 associated with CPM22-000011; and a request for the approval of a preliminary plat for an approximately 80.71 acres development consisting of two-hundred and sixty-six (266) residential lots and twenty-six (26) common lots for Midland Meadows Subdivision. Midland Meadows is proposed to be developed in three (3) phases. The subject site is located on the NWC and SWC of Midland Boulevard and Lincoln Road in Caldwell, Idaho. Page 2 of 2 5. Approve Resolution authorizing the transfer of funds in the amount of $887,347.68 from the Roadway Trust Fund to the Street Fund for the purpose of completed projects; 6. Approve Resolution authorizing the submittal of Special Tax Assessments to the Canyon County Auditor’s Office for weed abatements within FY-2023; 7. Approve Resolution from the Caldwell Fire Department declaring vehicles as surplus for disposition to public auction; 8. Approve Resolution for the Dedication of Sewer, Water, Pressure Irrigation and Street Light Facilities from Pontifex Capital for the Langley Hall Subdivision; 9. Approve Resolution authorizing the appointment of Public Works Director Robb MacDonald as the alternate member for the Valley Regional Transit Board; 10. Approve Resolution authorizing the acceptance of the updated Caldwell Police Department pay schedule effective October 1, 2023 for FY-2024; 11. Approve Resolution authorizing the acceptance of the apparent low bidder for the Rehabilitation of the Caldwell Pool Facility Project and authorize the Mayor to execute the accompanying contract(s); 12. Approve ratification of the execution for the Memorandum of Understanding with the City of Nampa and Canyon County for the 2023 Bryne Justice Assistance Grant (JAG) in the amount of $35,063 for the City of Caldwell. OLD BUSINESS: 1) ACTION ITEM: Public Hearing pursuant to Idaho State Code 50-1002 for consideration of the proposed budget for the fiscal year beginning October 1, 2023 and ending September 30, 2024. 2) ACTION ITEM: Consider Bill No. 31 (Ordinance No. 3525) Appropriation Ordinance for FY-2024 with the request to pass on the first reading by title only. 3) ACTION ITEM: Public Hearing pursuant to Idaho State Code 63-1311A to consider acceptance of the fees over 5% of that previously charged from the Caldwell Event Center, Fire Department, Golf Department, Police Department, Planning & Zoning Department, and Recreation Department. 4) ACTION ITEM: Consider Resolution No. 205-23 adopting a Schedule of Fees (FY-2024) fees for services provided and regulatory charges as specified by the Caldwell City Code for the Caldwell Event Center, Canyon Hill Cemetery, City Clerk Department, Caldwell Fire Department, Golf Department, Caldwell Public Library, Planning & Zoning Department, Caldwell Police Department, and the Parks & Recreation Department; NEW BUSINESS: 1. ACTION ITEM: Consider Mayor Wagoner’s recommendation for appointment of the Director of Aviation for the Caldwell Executive Airport. 2. ACTION ITEM: Pursuant to Idaho State Code 20-1002, consider acceptance of the Budget Amendment for FY-2022-2023 and set the public hearing date for Tuesday, September 5, 2023 at 6:00 p.m. 3. ACTION ITEM: Public Hearing: A request by Zach Turner on half of Rennison Companies to vacate a portion of right- of-way at the subject site known as 2605 Franklin Road. 4. ACTION ITEM: Consider Bill No. 30 (Ordinance No. 3524) to vacate a portion of right-of-way known as 2605 Franklin Road with a request to pass on the first reading by title only. 5. ACTION ITEM: Public Hearing (Quasi-Judicial): CPM23-000006, ZON23-000006: The City of Caldwell is requesting a comprehensive plan land use map amendment from OS (Open Space) to HDR (High Density Residential), and a rezone from C-2 (Commercial) to R-3 (High Density Residential), for the approximately 0.82 acres Parcel R35287104A0, to include approval of Resolution # 152-23 associated with CPM23-000006. The subject parcel is located on the south side of Thomas Jefferson Street, approximately 824’ east of the intersection of Smeed Pkwy and Thomas Jefferson Street, in Caldwell, Idaho. The Planning and Zoning Commission made a RECOMMENDATION TO THE CITY COUNCIL FOR DENIAL of the request for CPM23-000006 and ZON23-000006 at their July 26, 2023 public hearing. (Morgan Bessaw) 6. ACTION ITEM: Public Hearing (Legislative): ZOA23-000001: A request by the City of Caldwell Planning and Zoning Department to amend Chapter 10, Article 3, Section 10-03-12, pertaining to neighborhood meetings, by changing the title to address all public hearing processes; adds language to clarify the purpose of the neighborhood meeting and to increase the timeframe for conducting a neighborhood meeting prior to submitting an application; adds language to address the mailing and publishing of public hearing notices; adds language to address the physical site posting of public hearing notices by the applicant; and adds language to address the types of public hearings, decisions, decision criteria, conditions, hearing records, notice of decisions, requests for reconsideration, and appeals. This ordinance would be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; and repeals conflicting ordinances, resolutions, and orders. (The Planning and Zoning Commission made a RECOMMENDATION TO THE CITY COUNCIL FOR APPROVAL of the request for ZOA23-000001 at their July 26, 2023 public hearing. (Robin Collins) 7. ACTION ITEM: Consider Resolution authorizing the reallocation of ARPA funds from Infrastructure Project to the Caldwell Fire Department for the purchase of radios in the amount of $461,247.09. 8. ACTION ITEM: Consider Bill No. 32 (Ordinance No. 3526) to annex Cumberland Subdivision Phase 6 (Instrument No. 2023-004109) into the Caldwell Municipal Irrigation District with a request to pass on the first reading by title only. 9. ACTION ITEM: Consider acceptance of the Finance Report. 10. Council Reports. 11. Mayor’s Comments. a. Update report: Public Works Director regarding the Notus Canal Bridge Project/Rose Garden Hill Road. 12. Executive Session pursuant to Idaho Code, Section 74-206, Subsection (1)(c) for the purpose of discussing the acquisition of or an interest in real property not owned by a public agency. 13.
