PUBLIC MEETING INFORMATION
We invite interested parties to participate in public hearings either electronically or in person. If you have a cough, fever, or are not
feeling well, please contact Planning & Zoning staff to arrange participation remotely. The City of Caldwell follows the CDC
guidelines to allow for distancing in the public meeting area and provide masks/hand sanitizer on site.
Virtual Participation Option: Register in advance to provide public comments electronically or by telephone. During the registration
process, you will be asked what item on the agenda you wish to speak about. Please use the case number as listed within the written
notice.
On-line registration must be submitted at least 24 hours in advance of the meeting. Click on the green “public meetings” button on
the center of the page. After registration, you will receive a confirmation email containing information about joining the virtual

Written comments must be received at least eight (8) days in advance of the meeting to the Planning & Zoning Department at
P&Z@cityofcaldwell.org to be included within the staff report. All comments received after the staff report has been transmitted
will be included in the case file and provided as late exhibits at the appropriate public hearing.

CONSENT CALENDAR: [ALL CONSENT CALENDAR ITEMS ARE ACTION ITEMS]
1. The Caldwell City Council dispenses with the three (3) reading rule of Idaho Code §50-902 for
all ordinances.
2. Approve the minutes for the Caldwell City Council meeting held on July 5, 2023;
3. Approve Resolution declaring the disposition of excess city-owned equipment from the IT Department;
4. Approve Resolution authorizing the creation of a Parking Compliance Officer position with approval to
recruit for and fill one position;
5. Approve Resolution authorizing the execution of a revised Service Contract with Hach for equipment
located at the Wastewater Treatment Plant;
6. Approve Resolution authorizing the execution of a Purchase Agreement by the City Engineer with The
Wetlands Group for mitigation of wetlands consumed by the Ustick Road Widening Project (Indian
Creek Crossing) in the amount of $60,984.00;
7. Approve Resolution accepting Dedication of Right-of-Way and a Temporary Construction Easement
from Sundowner, Inc. located on the northwest corner of Montana Avenue and Ustick Road to facilitate
the construction of frontage improvements and a traffic signal at the site as initiated by the City of
Caldwell.
OLD BUSINESS:
1. ACTION ITEM: Public Hearing (Quasi-Judicial): This item was continued from July 5, 2023. Case
Number: SUB23-000009 (Prairie Creek): The applicant, J-U-B Engineers, on behalf of Endurance
Holdings LLC, is requesting approval of a preliminary plat for the Prairie Creek Subdivision, within an

R-1 (low density residential) zone and within a LDR (low density residential) comprehensive plan
designated area. Prairie Creek Subdivision includes approximately 40.74 acres with 119 single-family
residential lots, 18 common areas lots, 2 shared driveway lots and 1 irrigation lot, for a total of 140 lots.
The project is proposed to be developed in two (2) phases. The subject properties are located South of
Ustick and East of Bear Lane, on the NEC of Bear Lane and Laster Street, Parcel numbers R3258500000
and R3258501000, in Caldwell, Idaho. The Hearing Examiner, at the May 10, 2023 public hearing,
recommended approval of SUB23-000009 to be forwarded to City Council for consideration. (Staff

NEW BUSINESS:
1. ACTION ITEM: Consider Mayor Wagoner’s recommendation for appointment of the Public Works
Director.
2. ACTION ITEM: Public Hearing (Legislative) for receiving comments concerning the Community
Development Block Grant (CDBG) 2023 Annual Action Plan for Housing and Urban Development.
3. ACTION ITEM: Public Hearing (Legislative) for increases in Sewer and Water Fees over 5% of that
previously charged.
4. ACTION ITEM: Consider Resolution adopting the Public Works & Engineering Department Fees and
Policies.
5. ACTION ITEM: Accept the notice of a public hearing to be held on Tuesday, August 1, 2023 at 6:00
p.m. to consider proposed fee changes to the Impact Fees for Parks Department, Caldwell Fire
Department and the Caldwell Police Department.
6. ACTION ITEM: Consider Bill No. 37 (Ordinance No. 3521) amending the Caldwell City Code
Chapter 6, Article 23, Section 06-23-01 pertaining to Special Event Permits (Liability Insurance) with a
request to move for its passage by title only and accept the summary for publication.
7. ACTION ITEM: Consider Resolution approving the request for reallocation of ARPA funds from
infrastructure improvements to Economic Development for the purchase of a city-owned vehicle in the
amount of $34,913.00.
8. ACTION ITEM: Consider Resolution approving the request for reallocation of all remaining ARPA
funds in the 2022 ARPA Grant Award “Cybersecurity Fiber Extension Project” to the “Purple Sage
Water Main Line Extension” in the amount of $2,643,176.00.
9. ACTION ITEM: Public Hearing (Quasi-Judicial) - Case Number: ANN23-000009: The applicant
has chosen not to move forward with the application at this time and the hearing will not be heard on
July 18th. When the item is rescheduled for hearing it will be re-noticed.
A request by The City of Caldwell to annex parcel R3583300000 (8.49 acres), located at 3905 S Indiana
Avenue, in Caldwell, to include all adjacent rights of way along E Ustick Road and S Indiana Avenue,
with a proposed zoning of R-3 (high-density residential) which makes the zoning in conformance with
the currently adopted comprehensive plan map designation of HDR (High Density Residential). The
site is currently being used as a public park known as Brothers Park. There is no proposed changes to
the land use and no proposed additional development. The property is located on the NEC of East Ustick
Road and South Indiana Avenue in Caldwell, Idaho.
10. ACTION ITEM: Consider acceptance of the Finance Report.

Next Regularly Scheduled City Council Meeting is on Tuesday, August 1, 2023 at 6:00 p.m. in the
Community Room at the Caldwell Police Station at 110 South Fifth Avenue. Any person needing special
