Subject: Downtown Ordinance
Jarom — thanks for taking the time to discuss the new ordinance and the impact it will have on our properties downtown. I
am sorry I couldn't make the meeting on such short notice, but I wanted to have put into the record my adamant disapproval
of this ordinance and the ordinance that passed last year prohibiting office and medical uses as allowed uses on the first floor
in the downtown,
represent a group that owns buildings located at 1131" 7111 Street, 712 Arthur and 812 Main. I am against this ordinance for a
number of reasons including:
• 1 am unaware of a downtown in the valley, state or country that prohibits office on the first floor. I have asked the
Economic Development for examples of ordinance like this that work and none have been provided.
• There are numerous examples of downtowns in this valley where office on the first floor are successful and enhance
the downtown. Given the short time frame I had I was unable to provide examples, but I will submit prior to the next
meeting.
• Most of the buildings that I am aware of in downtown Caldwell need significant improvements in order to obtain
occupancy permits for office users on the second floor and above. It is my opinion that given today's construction
costs the rent an owner must achieve to pay for those improvements will be significantly higher than the current and
foreseeable market rate.
• Restaurants need people and lunch crowds to survive. Restricting office uses, in my opinion, will only make it more
difficult for additional restaurants to become successful.
• To the best I can tell Destination Caldwell submitted their business license (even though they didn't have an
occupancy permit) the day before the previous ordinance was passed restricting office and their own use. The is a
great example of a great use that would no longer be allowed.
• Finally and stating the obvious the City of Caldwell has made significant investments in the downtown, I do not
understand why they are now taking measures to restrict people from working and making trips downtown. I
strongly believe overtime the market will demonstrate as more people are downtown the need for more services will
increase.
