SUGGESTIONS FOR TESTIFYING AT PUBLIC HEARINGS
1. Remember your objective... It is your objective to persuade the decision makers to vote or decide in favor of your side of the
issue. It will not help your cause to anger, alienate or antagonize the decision makers who are listening to your presentation.
2. Show your strength... Many neighborhood groups have organized their testimony by having one or a few people speak on
behalf of the group. The leader will ask those in the audience supporting the testimony to stand. This conveys to the decision
makers the seriousness with which the issue is viewed by the attending parties.
3. Speak to the point... Public officials have heard hundreds of people give testimony They are grateful when the testimony is
pertinent, well organized, and directly regards the matter at hand. Long stories, lectures or philosophy, abstract complaints
about generalities, or redundant testimony are usually a poor use of time.
4. State your recommendation.
5. Be informed.... Get a copy of the plan being heard, the staff report, the proposed ordinance, or other pertinent material. Then
read it and plan your comments accordingly.
6. If you don't wish to speak, write it down... and submit it prior to the hearing. If written testimony is specific, to the point
and concise, it will be given as much attention as oral testimony.
7. Be reasonable. —Put yourself in the shoes of the decision makers. They must balance all points of view, interests and
proposals being made, and find the best course for the overall public good. While. Be prepared to compromise.

Call to Order Chairperson Doty-Pomoransky called the meeting to order at 7:07 p.m.

Old Business: Approve minutes of April 10, 2018 regular meeting.
MOTION: Commissioner Vance. SECOND: Commissioner Hunsicker. Passed: Unanimous roll call
vote.
New Business:
Since the applicant for Case Number ZON-18-04 has not arrived, we have changed the order of the
Agenda:
1. Case Number ZON-18-05: A request by Matthew Witt and 21St & Chicago LLC to rezone
5.9 acres, more or less, from M-1 (Light Industrial) to C-3 (Service Commercial). The
subject property is located on the north side of Chicago Street approximately 800 feet
east of the intersection of Chicago Street and 21st Avenue (Parcel # R3537301300) in
Caldwell, Idaho.
Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, presented the staff report.
Mr. Wagoner stated the applicant is requesting to rezone approximately 5.9 acres from M-1 (Light
Industrial) to C-3 (Service Commercial).
Mr. Wagoner stated our comp plan shows this area as Commercial and we really don't want
Industrial along this roadway.
Mr. Matthew Witt, 350 N. 9th Street, Ste 200, Boise Idaho stated he has been working with City staff
on this development for 1.5 years. They have received interest in this parcel but it needs to be
rezoned.

Commissioner Doty Pomoransky asked about Condition 8.4 and if they were in agreement.
Mr. Witt said that in concept he does not have a problem with the condition of approval at all but that
property is under separate ownership. He doesn't have latitude to speak of what the future
development will be on the southern portion to be able to tie that together. He doesn't have any issue
with making that cross access if they can cohabitate their design.
MOTION TO CLOSE PUBLIC TESTIMONY: Commissioner Vance. SECOND: Commissioner
Hunsicker. Passed: Unanimous roll call vote.
Findings of Fact: Introduction of Exhibit PZ-1000. The Caldwell Planning and Zoning Commission
accepts the Findings of Facts components as listed. MOTION: Commissioner Vance. SECOND:
Commissioner Hunsicker. Passed: Unanimous voice vote.
Conclusions of Law: The Caldwell Planning and Zoning Commission accepts the Conclusions of
Law components as listed. MOTION: Commissioner Vance SECOND: Commissioner Hunsicker
Passed: Unanimous voice vote.
RECOMMENDATION FOR ZON-18-05 (REZONE) MOTION: Commissioner Hunsicker that Case
Number ZON-18-05 be approved with the following conditions: 8.2-8.7

2. Case Number OA-18-02: A request by the City of Caldwell Planning and Zoning
Department to amend portions of Chapter 10, the Zoning Ordinance, of City Code
Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 83605, Senior Planner, stated this is a proposal
from the City of Caldwell's Planning & Zoning Department to amend portions of Chapter 10 City
Code. This request is part of our annual cleanup of Code.
Mr. Wagoner reviewed all the changes requested and answered questions then read a letter from
Mr. David Cadwell (Exhibit PR-1).
RECOMMENDATION FOR OA-18-02 (Ordinance Amendment) Introduction of Exhibit PR-1.
Commissioner Vance that Case Number OA-18-02 be approved. SECOND: Commissioner Hunsicker.
Passed: Unanimous roll call vote.

Testimony:
Jarom Wagoner, 621 Cleveland Blvd., Caldwell, ID 63605, Senior Planner, stated the applicant is
requesting to rezone approximately 0.56 acres from C-3 (Service Commercial) to R-1 (Low Density
Residential) and to re -designate the property to be within the APO-2 Airport Overlay Zone. The
applicant intents to sell the property to allow for the construction of a single-family dwelling.

Commissioner Vance wanted to confirm that there is not anything in the Development Agreement
for Monarch Subdivision for this parcel.
Mr. Wagoner stated that was correct.
Mr. Josh Hobdey, 10921 Cocoon St., Nampa, Idaho stated he is the intended purchaser of this
property. He lives in Monarch Subdivision and noticed nothing had ever been done with this
parcel. He tracked down the owner and asked if he could purchase the property with the condition
it be rezoned to R-1.
Lyndsay Hobdey, 10921 Cocoon St., Nampa, Idaho signed in favor but chose not to speak.
Kris Waldram, 17721 Monarch Way, Nampa, Idaho signed in favor but chose not to speak.

1.1 The Caldwell Planning and Zoning Department issued a notice of Public Hearing on application OA-
18-02, to be held before the Caldwell Planning and Zoning Commission on June 12, 2018. Public
notice requirements set forth in Idaho Code. Chapter 65, Local Planning Act, have been met. On May
27, 2018 notice was published in the Idaho Press Tribune. Notice was sent to all political
subdivisions located within Caldwell's area of impact and within the City of Caldwell on May 25,
2018.
1.2 On June 12, 2018 the Caldwell Planning & Zoning Commission recommended approval of the
ordinance amendment.
1.3 Files and exhibits relative to this application are available for review in the Caldwell Planning and
Zoning Department, 621 Cleveland Blvd., Caldwell as well as applicable public hearings.

V PLANNING & ZONING COMMISSION'S RECOMMENDATION
5.1 Based on the Comprehensive Plan analysis and testimony, the Planning & Zoning Commission
hereby recommends to the Mayor and City Council that Case No. OA-18-02, a request by the City of
Caldwell Planning and Zoning Department to amend and update Chapter 10, the zoning ordinance,
of Caldwell City Code be approved.
Case # OA-18-02 was heard by the Planning & Zoning Commission at a public hearing held June
12, 2018.
The Findings and Recommendation were administratively approved and signed by the Planning &
Zoning Chairman on the date noted below.
