XXXX AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING VARIOUS ARTICLES, SECTIONS, SUBSECTIONS AND TABLES IN THE "CALDWELL ZONING ORDINANCE," FOUND IN CHAPTER 10 OF THE CALDWELL CITY CODE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho, following duly noticed hearings before the Planning & Zoning Commission, on June 12, 2018; and the City Council on July 2, 2018: Section 1. That Chapter 10, Article 2, Section 10-02-04 of the Caldwell City Code, governing various aspects of land use, including accessory buildings, structures, and uses be amended, as follows: 10-02-04: ACCESSORY BUILDINGS, STRUCTURES, AND USES: (3) The following table (applicable only to RS-1, RS-2, R-1, R-2, and R-3 districts and to residential dwellings in C-C, T-N, H-C, C-D and H-D districts) shows where accessory buildings, structures, and uses are permitted, with respect to the location of the principal structure, as follows (except that sheds and storage buildings for garden equipment and household items may be located on a side yard adjoining a street in instances where a parcel or lot has no available interior side yard or rear yard area and where the property is not located within the Steunenberg residential historic district): Front Side Yard Yard Accessory Building, Structure Or Adjoining Interior Side Rear Use A Street k Yard Yard Sheds and storage buildings for garden equipment and household items XX X Notes: 1. That Chapter 10, Article 2, Section 10-02-13 of the Caldwell City Code, governing temporary use and transient merchant facilities be amended, as follows: 10-02-13: TEMPORARY USE MERCHANTS, TRANSIENT MERCHANTS, BUSINESS PERMITS AND SPECIAL EVENTS: (3) Temporary Use And Transient Merchant Facilities Regulations: All temporary uses and transient merchants and associated facilities shall be subject to the following conditions and regulations: S. Mobile food units, as defined in section 10-03-11 of this chapter and as a permitted use in the city center district and in other zoning districts as indicated in the land use schedule located in section 10-02-02 of this article, shall comply with all requirements of a temporary use excepting the following: BILL No. XX, ORDINANCE No. XXXX - PACE -3 A r 1. Section 5. That Chapter 10, Article 3, Section 10-03-11 of the Caldwell City Code, governing Definitions be amended, as follows: 10-03-11: DEFINITIONS: For the purpose of this chapter, certain terms are defined as set forth herein. All words in the present tense include the future tense. The plural includes the singular, and all words in the singular include the plural unless the nature of construction of the sentence indicates otherwise. The word "shall" means something is mandatory. CENTRAL BUSINESS DISTRICT (CBD): The area located between 51h Avenue, 1 Oth Avenue, Union Pacific Railroad, and Indian Creek in downtown Caldwell. Section 6. That Chapter 10, Article 7, Sections 10-07-02, 10-07-08, and 10-07-11 of the Caldwell City Code, governing landscape applicability, street landscape buffers, and pathway landscaping standards, be amended as follows: 10-07-02: APPLICABILITY: (2) Application: This article shall apply in the following situations: I. Rezones, Annexations, or Simple Lot Splits. 10-07-08: STREET LANDSCAPE BUFFERS: BILL No. XX, ORDINANCE No. XXXX - PACE - 5 A (5) Required Landscaping And Improvements Within The Street Buffers: A. Mixture of trees, shrubs, lawn, vegetative and nonvegetative ground cover so that the entire buffer area is covered..A minimum of 70% of the buffer area shall be covered with a turf -type grass. For new plantings, grass sod installation is required. Seeding, hydro -seeding, or similar methods shall not be allowed. 10-07-11: PATHWAY LANDSCAPING STANDARDS: (6) Public Pathway And Landscaping Requirements: C. Public Pathway Standards: 6. Fencing: All public pathways are required to have fencing installed along both sides of the pathway. Fencing shall be open vision up to six feet (6') in height. Solid fencing may be used if it does not exceed four feet (4') in height, which includes the height of any trellises or other open vision fencing placed on the top of a solid fence. Section 7. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 10. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity.
