I COURSE OF PROCEEDINGS
1.1 The Caldwell Planning and Zoning Department issued a notice of Public Hearing on
application OA-122-09, to be held before the Caldwell Planning and Zoning Commission on
December 8, 2009. Public notice requirements set forth in Idaho Code, Chapter 65, Local
Planning Act, have been met. On November 22, 2009 notice was published in the Idaho
Press Tribune. Notice was sent to all political subdivisions located within Caldwell's area of
impact on November 13, 2009.
1.2 On December 8, 2009 the Planning and Zoning Commission recommended approval of the
request for creation of a Pathways and Bike Routes Master Plan.
1.3 Files and exhibits relative to this application are available for review in the Caldwell Planning
and Zoning Department, 621 Cleveland Blvd., as well at all public hearings.
II GENERAL FACTS
2.1 APPLICANT: Brian Billingsley, AICP, Caldwell Planning and Zoning Director, 621 Cleveland
Blvd., Caldwell, ID 83605
2.2 REQUEST: This is a proposal by the Planning and Zoning Director to adopt a Pathways and
Bike Routes Master Plan as "Appendix D" to the Caldwell Comprehensive Plan.
2.3 BACKGROUND: This is Caldwell's first ever plan that deals with pathways and bike routes. A
citizen advisory committee was formed in December 2008; this committee held monthly
meetings to formulate policies and create routes for pedestrian and bicycle facilities.

RECOMMENDATION
The plan's main goal is to provide enhancements to the city by creating a comprehensive
pedestrian and bicycle plan that is based on the principles of continuity and minimal public
economic impact while maximizing public accessibility and efficiency through major
improvements. The plan focuses on building pathways in underserved neighborhoods and
establishing bike routes on the city's street system.
Prior to the completion of the plan, a 45-day public review period was held for the general
public to review the master plan. The plan was available for review on the City's website.
Staff hosted two events where we met with the general public to discuss the master plan. The
first event was an open house held in the Caldwell Police Station on September 17, 2009.
Staff also set up an informational booth at the Indian Creek festival on September 19, 2009.
2A OVERVIEW OF THE PLAN:
• Chapter I is the introduction. This chapter explains the need for a master plan; mission
statement; reasons why we need a plan; principles of pathway and bike route
development; and definitions.
■ Chapter II explains the existing condition of our pathway and bike route system. This
section highlights featured destinations for the pathway system, current pathways and bike
routes.
■ Chapter III contains design standards. This section recommends how a pathway or a bike
route should be built. This section also suggests amenities that should be provided to
serve the users of the pathway system.
■ Chapter IV is the plan for new pathways and bike routes. The plan recommends nine (9)
major pathways and 35 bike routes on Caldwell's street system.
• Chapter V deals with the implementation of the plan. Recommendations for development
standards are given in this section. The plan also recommends the formation of a
permanent city advisory committee who will make pathway and bike route
recommendations to the city council.
III APPLICABLE LEGAL STANDARDS
3.1 City of Caldwell Zoning Ordinance, as amended.
3.2 City of Caldwell Comprehensive Plan, as amended.
3.3 Idaho Code, Title 67, Chapter 65, Local Planning Act
IV TESTIMONY
4.1 Brian Billingsley, Planning and Zoning Director, presented the staff report and submitted a
map labeled as exhibit PZ-1000.
4.2 The Commissioners discussed at length the location and width of the proposed pathways, bike
routes, and the possibility of adding a pathway connecting the Boise River Pathway to the
Caldwell Airport with Mr. Billingsley.
V COMPREHENSIVE PLAN ANALYSIS
The Planning and Zoning Commission accepts the Comprehensive Plan components as listed
below.
5.1 CONSISTENT WITH THE COMPREHENSIVE PLAN: The request is consistent with the following

components of the Comprehensive Plan:
Property Riahts -
GOAL: To ensure that land use policies, restrictions, conditions and fees do not violate
property rights, adversely impact property values or create unnecessary technical limitations
on the use of the property.
OBJECTIVE A: To establish a sound basis for land use and environment regulations through
comprehensive planning and adopted policies and ordinances.
POLICY 1: Planning and zoning actions may be subject to a regulatory takings analysis
provided in section 67-8003 of the Idaho Code. Staff will follow the Attorney General's
Checklist Criteria outlined in the Idaho Regulatory Taking Act Guidelines prior to initiating any
proposed regulatory or administrative action on specific property, and to request legal
counsel's review if any one of the criteria is answered in the affirmative. Staff reviewed the five
criteria outlined in the Takings Act Guidelines and did not answer yes to any of the criteria.
5.1.2 School Facilities & Transportation —
GOAL: To provide on -going opportunity for school representatives of Caldwell and Vallivue
School Districts to participate in the community planning process.
POLICY 3: Encourage developers to include pedestrian/bike ways that interconnect with
adjacent or planned school facilities when designing plats for subdivisions.
5.1.3 Land Use —
GOAL I: To establish land -use management policies that protect property rights and the
environment, maintain a high quality of life, provide adequate land for all types of
development, and adequately buffer non -compatible uses.
GOAL II: To create a strong sense of community and place.
GOAL IV: To create communities that accommodate cost effective public services and
infrastructure.
OBJECTIVES APPLICABLE TO ALL LAND USES:
OBJECTIVE A: To guide the growth and development of land uses in such a way that the
health, safety, and general welfare of residents will be protected.
OBJECTIVES APPLICABLE TO THE AREA OF CITY IMPACT
OBJECTIVE D: To create walkable neighborhoods with neighborhood commercial centers and
a grid street layout.
5.1.4 Public Services. Utilities, and Facilities —
GOAL l: To ensure that there are adequate public services and infrastructure to meet the
needs of the public.

GOAL II: To optimize the public investment in services and facilities.
OBJECTIVE A: To provide for the orderly expansion of public services to meet the needs of
population growth, and ensure that adequate infrastructure is in place to serve new
development.
OBJECTIVE C: To maintain adequate levels of public facilities and services that will serve the
diverse needs of the city.
POLICY 7: Analyze use of impact fees as a means of funding the costs of new development.
5.1.5 Transportation —
GOAL I: To provide for the efficient, safe, and cost-effective movement of people and goods.
GOAL II: To protect public safety and the environment.
GOAL III: To create communities with more cohesive, interconnected and walkable
neighborhoods.
GOAL IV: To promote healthy lifestyles.
OBJECTIVE A: To encourage the adoption of standards for parking and street sections that
strike a balance between safe access, adequate parking, fire safety, and support for
pedestrian circulation.
OBJECTIVE B: Strive to develop a system of transportation connectivity that integrates roads,
pathways, and waterways to maximize biking, walking, and recreation pursuits.
OBJECTIVE F: To connect social and cultural centers together through pathway systems.
POLICY 3: Encourage new residential development to incorporate safe and interconnected
bicycle and pedestrian ways in their platting efforts as alternatives to high vehicular volume
arterials. Whenever appropriate, require new developments to interconnect with public school
grounds and with other residential development through the use of bicycle and pedestrian
ways.
5.1.6 Parks. Recreation, and Open Space —
GOAL I: To develop and preserve parks, green belts, and recreational facilities to meet the
diverse needs of a growing community.
OBJECTIVE A: To provide increased recreational facilities and opportunities for all citizens.
OBJECTIVE C: To develop a trail and pathway system for non -motorized use that will provide
linkages between other recreation sites and between residential neighborhoods and service
areas.
POLICY 1: Encourage the development community to install interconnecting trails and
pathways between residential developments, schools, parks, and/or commercial areas.

POLICY 2: Encourage the development community to install trails and pathways along the
Boise River and Indian Creek.
POLICY 3: Promote the incorporation of bike paths into the construction and reconstruction of
roadways, where feasible.
POLICY 5: Incorporate pathways, ponds, and irrigation features into park designs.
5.1.7 Community Design —
GOAL I: Foster growth in a manner that will enhance and improve the City's visual image.
OBJECTIVE A: To promote, encourage and maintain an aesthetically pleasing city.
POLICY 4: Establish standards for the incorporation of open space, recreational areas, trails
and/or pathways within any residential development.
VI PLANNING & ZONING COMMISSION'S RECOMMENDATION
6.1 Based on the comprehensive plan analysis and testimony provided, the Planning & Zoning
Commission hereby recommends to the Mayor and City Council that Case No. OA-122-09, a
request by the Planning and Zoning Director to adopt the Pathways and Bike Routes Master
Plan as "Appendix D" of the Caldwell Comprehensive Plan, be approved.
6.2 Amend the map to add a pathway connecting the Boise River Pathway Corridor to the
Caldwell Airport.

B. Case Number SUP-328-09 a request by Gloria Easteppe and Gene Dillon for a special
use permit for a duplex in an R-1 Low Density Residential zone located at 260)
Hillcrest.
Testimony:
1) Anne Marie Skinner, Senior Planner/Community Development Coordinator,
presented the staff report with a correction to condition 8.10 changing south to
north and adding LID information. She also presented an aerial map of the site
labeled as exhibit PZ-1000.
2) Valarie Hruza, applicant's representative, signed in favor of the application and
provided supporting testimony.
