NOTICE IS HEREBY GIVEN that the Caldwell Hearing Examiner will
conduct a public hearing on Tuesday, May 14, 2013 at 7:00 p.m., or as soon
thereafter as the matter may be heard, in the Community Room of the
Caldwell Police Department, 110 S. 5th Avenue, Caldwell, Idaho in order to
hear the following:
Case No. ZON-85-13 and SUP-357-13, a request by Liwy Albizo for a
comprehensive plan map change from Low Density Residential to High
Density Residential, a rezone from R-1 Low Density Residential to R-3 High
Density Residential, and special use permit approval for a Level 111.1 Clinically
Managed Low -Intensity Residential Treatment Facility for Adults (Halfway
House) in an R-3 zone located at 1805 Blaine Street.
You are being notified because Idaho Code, 67-6509, Local Planning Act 67-
6509, requires notice of this public hearing to be provided to all political
subdivisions providing services to the site and to all property owners or
purchasers of record who own property within 300 feet of the subject area.
Correspondence regarding the proposal is to be submitted to the
Planning & Zoning Department no later than five (5) working days prior
to the public hearing. Public testimony will be taken at the hearing and
made a part of the record.
Case riles and exhibits relative to this request are on file at the Caldwell Planning & Zoning
Department and are available for review during the hours of 8.00 a.m. to 5:00 p,m. Monday
through Friday. Further information can also be obtained by calling 455-4662 and by leaving a
message if after-hours. Information can also be requested by emailing Anne Marie Skinner at
amskinne ci.caldwell.id. us or faxing her at 455-3050. A person who is visually and/or hearing
impaired, or needs an interpreter should contact the City at least 24 hours prior to the heating.
SUGGESTIONS FOR TESTIFYING AT PUBLIC HEARINGS
1. Remember your objective ... It is your objective to persuade the decision makers to vote or decide in favor of ywr side of the
issue. It will not help your cause to anger, alienate or antagonize the decision makers who are listening to your presentation
2. Show your strength ... Many neighborhood groups have organized their testimony by having one or a few people speak on behalf
of the group. The leader will ask those in the audience supporting the testimony to stand This conveys to the deciszan makers the
seriousness with which the issue is viewed by the attending parties.
3. Speak to the point ... Public officials have heard hundreds of people give testimony. They are grateful when the testimony is
pertinent, well organized, and directly regards the matter at hand. long stories, lectures or philosophy, abstract complaints about
generalities, or redundant testimony are usually a poor use of time.

5. Be informed.... Get a copy of the plan being heard, the staff report, the proposed ordinance, or other pertinent material. Then read
it and plan your comments accordingly.

"To Whom it May Concern:
I am a Senior Planner with the City of Caldwell. I was asked by Mrs. Livvy Albizzo to provide you with a written
statement that the City of Caldwell is aware of the Group Home for eight (8) or fewer residents which she intends to
operate at 1805 Blaine Street, in Caldwell, Idaho. It is our understanding that she intends to provide treatment at that
location for clients who are mentally ill and/or who are dealing with substance abuse issues.
Under the Caldwell City Code, at Section 10-3-11, the term "Group Home, Eight or Fewer Residents," is defined, in its
entirety, as follows:
GROUP HOME, EIGHT OR FEWER RESIDENTS: The use of property as a group residence in which eight (8) or
fewer unrelated mentally and/or physically handicapped or elderly persons reside and who are supervised at the
group residence in connection with their handicap or age related infirmity. Resident staff, if employed, need not
be related to each other or to any of the mentally and/or physically handicapped or elderly persons residing in
the group residence. No more than two (2) of such staff shall reside in the dwelling at any one time. The
department of health and welfare may require group residences, as herein defined, to be licensed and set
minimum standards for providing services or operation. Such licensure may be under the residential or assisted
living facility rules, or under the intermediate care facilities for mentally retarded or related conditions rules, or
under rules specifically written for such group residences. No special use permit, zoning variance, or other
zoning clearance shall be required of a group residence, as herein defined, which is not required of a single-
family dwelling in the same zone. No local ordinances or local restrictions shall be applied to or required for a
group residence, as herein defined.
This definition, as herein defined, and use does not include or apply to tenancy or planned tenancy in a group
home or residence by persons who are under the supervision of the state board of correction pursuant to
section 20-219, Idaho Code, or who are required to register pursuant to chapter 83 or 84, title 18, Idaho Code,
or whose tenancy would otherwise constitute a direct threat to the health or safety of other individuals or
whose tenancy would result in substantial physical damage to the property of others (see definition of
Transitional Homes).
In our discussions with Mrs. Albizzo and her representative, Donald Easteppe, they have confirmed that it is Mrs.
Albizzo's intent to establish a home that meets the definition set forth above, and that they do not intend to admit any
client whose tenancy would render the facility a "Transitional Home" (e.g., clients "who are under the supervision of the
state board of correction pursuant to section 20-219, Idaho Code, or who are required to register pursuant to chapter 83
or 84, title 18, Idaho Code, or whose tenancy would otherwise constitute a direct threat to the health or safety of other
individuals or whose tenancy would result in substantial physical damage to the property of others").
Because Mrs. Albizzo intends to operate a Group Home, no special use permits, zoning variances, or other zoning
clearances are required for that purpose that would not be required of any single-family dwelling in the same zone.

Because no formal "approval" or "certificate" must be issued by the City before Mrs. Albizzo may begin operating the
Group Home, I am hopeful that this letter will suffice for your purposes. If you require any further information from the

Mr. Seable,
As previously mentioned I am suggesting to Mrs. Albizzo to re -approach the City of Caldwell in
request of a "Certificate of Occupancy" for a "Group Home" dealing with mental illness and substance
abuse issues on friday April 26, 2013. This group home shall provide services for not more than 7
clients to be considered in -patient at one time, and it will not occupy more that 2 paid staff members
on site at one time. It is agreed that all City of Caldwell ordinance, Canyon County requirements,
State of Idaho codes and Federal Laws and requirements will be met as required.
