ORDINANCE NO. 2939
AN ORDINANCE AMENDING CHAPTER 10 OF THE CALDWELL CITY CODE, WHICH IS THE ZONING
ORDINANCE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho:
Section 1. That Chapter 10 of the Caldwell City Code shall be amended as follows:

Section 10-02-03(1) 10-02-03(1) The minimum lot area for each dwelling unit above that which is required for a single-family
dwelling shall be one thousand (1,000) square feet for the first dwelling unit and We family dwellings shall
two thousand (2,000) square feet for each additional unit unless the lot area is permitted to be reduced by
planned unit development procedures.

height should not be allowed, placed, erected, or constructed in any vision triangle as defined below.
Section 10-02-07(2)F.1. "Vision triangle": Defined as measuring from the intersection of the edges of two (2)
adjacent roadways forty feet (40') along each roadway and connecting the two (2) points with a straight line. The
edge of the roadway shall be defined as the curb or where the curb would be if no curb is installed. Driveways
are not considered roadways for this definition.

Section 10-02-09(7) All home occupation permits, including those in existence prior to and upon the effective
date hereof, shall be subject to scheduled or unscheduled annual inspections for compliance and by the
planning and zoning department_ . Permits
shall be compliant with all federal, state, and city codes and regulations in place at the time of inspection.
Permits found to be noncompliant upon aRRual any inspection may be revoked by
the planning and zoning director or his/her authorized designee if compliance is not accomplished within thirty
(30) days of notification of noncompliance. The planning and zoning fee for the annual renewal of home
occupation permits, as well as any applicable inspection fees, shall be paid upon submittal of the renewal
application and shall be the amount set forth by city council through resolution.
Section 10-03-11 Payday Loan/Title Loan/Quick Loan Establishments: An establishment that primarily engages
in facilitating credit intermediation offering small -dollar, short-term, unsecured loans: regardless of whether
repayment. of loan is linked to a borrower's payday. Also to include establishments where the primary services
offered are for car title loan's that are typically short-term.

Section 2. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 3. This ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.
Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid
by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be
read to carry out the purposes of the ordinance before the declaration of partial invalidity.
