I would like to submit the following opposition to the above noted case.
Here are the following issues that are my concerns with this proposal:
In section 07-06-05 of the zoning amendment criteria, there are 8 specific things that need to
be thought through for a change in rezone of an area. Of the 8, there are several that concern
me and violate what is deemed appropriate for the zoning change to the property on Amber
Street. These same criteria are repeated in section 07-06-07 (conditional rezone) paragraph 6
with the statement that "the presiding party shall apply the following standards when
evaluating conditioned rezone":
1) Is the proposed conditional rezone generally consistent with the comprehensive plan;
2) When considering the surrounding land uses, is the proposed conditional rezone more appropriate
than the current zoning designation; of
3) Is the proposed rezone compatible with surrounding land uses; ..
4) Will the proposed conditional rezone negatively affect the character of the area? What measures will ..
be implemented to mitigate impacts; ..
5) Will adequate facilities and services including sewer, water, drainage, irrigation and utilities be Of
provided to accommodate proposed conditional rezone; ..
6) Does the proposed conditional rezone require public street improvements in order to provide adequate,
access to and from the subject property to minimize undue interference with existing or future traffic
patterns? What measures have been taken to mitigate traffic impacts;
7) Does legal access to the subject property for the conditional rezone exist or will it exist at the time of
development; and

8) Will the proposed conditional rezone amendment impact essential public services and facilities, such
as schools, police, fire and emergency medical services? What measures will be implemented to mitigate
impacts? "
Regarding bullet 1, the area is already zoned R-1, as that is consistent with the residential
housing across the street. This property, even if it was a some point zoned C-1, they changed it
for some reason, and I believe it should stay that way, as it will be consistent with what the
planning and zoning board has already deemed appropriate use for this land.
I also think that the surrounding land use is residential with homes and that Amber street should
stay residential, as the city and schools will benefit more long term with homes there for taxing
purposes than a commercial property that won't benefit anyone other than the investors initially
unless there are strict guidelines adhered to when the commercial properties are sold if the
rezone has to take place.
The only surrounding land that is commercial property is my dental office, however, the office
has only direct access on to I0`h avenue and has an address for 10t' Ave. All other properties on
Amber Street are residential only. This comes into direct violation of bullet 3 listed above.
As pertaining to bullet 4, I have concerns that this commercial property will make traffic too
high for the street and increase the exiting traffic onto I Oth avenue, making the busing traffic
even more difficult to deal with and will get in their way as they come onto Amber street each
day. I ask that a traffic study be done before any attempt at rezone be made to make sure the
public is going to be okay. Commercial buildings won't benefit anyone on Amber street as it will
only increase the parking on the street and get in the way of the busing.
The vacant property has sewer and water lines that can be pulled onto it, but the drainage is very
concerning and will violate bullet 5. The land is very sloped from west to east and any rain or
snow melt that occurs now mostly sinks into the ground and flows east down into the thruway
where the buses go to drop off and pick up the kids. If this property is allowed to be rezoned,
the black top will increase the flow significantly down towards the lower end of the property and
presumably flood that driveway that the school buses use. There is nothing on the plan to
address this and I think it would be wise to make sure and have the city mandate the developer to
place the finest drainage for this property the entire length of the property to ensure the flooding
doesn't occur. But I believe that with residential housing, the grass and ground would be enough
to mitigate the issue and not have to place significant drainage on the properties if left as R-1.
I have already discussed that the traffic will increase and place increased danger with any
commercial buildings on the property; the owners, the employees and patrons to the businesses
with not make anything easier but congest all traffic and tighten the street so that the buses will
have a more difficult time trying to turn onto Amber Street. Also, if the proposed development
is to go forward and you do make the decision to rezone, the developers need to pay for
widening and finishing Amber street, as it is only wide enough to safely support one car width.

The sidewalks need to be completely finished and an 8 foot fence needs to be placed between its
property and mine.
And finally, with a residential property, as it is already zoned, the property will comply for bullet
8, as the rezone to C-1 will violate said bullet point. This rezone would impact the school next
door, my business because of increased traffic that will make it harder for my patients to try and
turn into my parking lot and will increase the chances of more accidents with more cars trying to
turn onto Amber street and trying to exit to the south onto 100' Avenue.

Amber Street, 1 would like to express my support for this project. [ believe there is a great
need for this in our community and will be a good addition to this part of Caldwell.
