Unfortunately, I am out of town for work and unable to attend the Planning & Zoning meeting on 3113. Thank you for accepting this letter in my absence. am writing to express my opposition to the proposed rezoning of 5106 S. 1 oth Avenue, request ZON-18-02. 1 believe allowing this rezoning is inconsistent with the comprehensive master plan, it compromises the livability for surrounding residents, benefits only the owner of the property in question, and raises significant safety concerns. Not least of which is the safety of all the kids on the west side of 10th who are zoned for Lewis & Clark elementary and already struggle for a good way across 10th avenue — this would make it far worse and difficult to remedy. Previously, this board denied a re -zoning request because the rationale for the request was to make the property more marketable. I would contend that there is no change in the rationale for this request so there should be no change in the board's decision. It is classic spot zoning, driven purely by the desire to sell the property. We all appreciate the need and desire to sell the property; however, there is no justification for putting the marketability of this property over the marketability and livability of every other home and property that surrounds it. The R-3 re -zoning is entirely inconsistent with the surrounding parcels and it is a deviation from the comprehensive master plan, which specifies R-1 for this parcel. Additionally, the quantity (64) and type (individually sold 4-plexes) raise serious questions about maintenance and management of the property as well as concerns about the adequacy of loth avenue to absorb the vehicle traffic. As for the C-2 re -zoning request, the comprehensive plan map identifies this area as R-1, and, although there is apparently a "commercial overlay" along 10th that allows for C-1 or C-2 zoning, the proposed rezone at this location seems very inconsistent with the objective of "orderly growth" that is called for in the comprehensive plan. In my opinion, commercial development would be most orderly if done transitionally. So rather than rezoning in the middle of the block surrounded by R-1 parcels, you would put a commercial development next to the Maverick or the Walgreens, then next to that, and so on down the block. And there are already commercially zoned parcels in those locations that are for sale, so it seems unnecessary to rezone an R-1 parcel, which isn't adjacent to any other commercial parcel, when there are available C-1 and C-2 zoned parcels on the same block. Additionally, the master plan identifies commercial development at the NE corner of Homedale and 10'h, so if we needed to rezone in order to add commercial development, it seems that would be the more appropriate location. There are many other concerns related to traffic, noise, safety, the quality of the development and I will let my neighbors will speak to those in much more detail. Thank you.
