One is located at 716 Blaine St. and the other at 702 Main St. We are in the process of improving those properties to bring them to their highest and best use in relation to their contribution to the downtown core and Indian Creek Plaza. The building at 116 Blaine St. was previously a fly fishing shop (Angler's Habitat) which failed and is currently vacant. We have an executed lease for an axe throwing venue to locate in that building (Section 37 Axe Room) which requires some changes and improvements to accommodate the new use. Section 37 are experienced, successful operators with a current location in Boise wishing to expand their operation to Caldwell. We believe our building is ideally suited and located for this use and would make a positive contribution to the development of downtown Caldwell. We submitted plans for those improvements where Planning and Zoning categorized our axe throwing application as amusement versus recreational which requires a special use permit. We believe axe throwing should be categorized as recreational because it resembles the uses described in the code for recreational and has little resemblance to amusement. Most notably axe throwing is a single use activity much like a bowling alley (which is specifically designated as recreational) with multiple stalls, each with a target much like bowling lanes. When we first began exploring the idea of investing in Caldwell we were impressed with the business friendly rhetoric we heard with regard to most specifically downtown restaurant and activity development. We invested with the understanding that what Caldwell wants and needs is a fun downtown and is eager to cooperate to achieve that. We feel that our proposed axe throwing venue fits with that goal nicely and ask that it be designated as recreational without requiring a special use permit. Thank you for your consideration. In this letter it was determined that our Section 31 Axe Room Tenant Improvement was classified under the land -use designation of "Amusement Center" which in the City Center Zoning District requires a special use. We believe our particular use is more closely aligned with "Arts, Entertainment or Recreation Facility", specifically the Recreational and Entertainment designations. This particular use does not require a special use. As you are aware, we have already submitted a building permit with this designation in mind, and with City Council's agreement would like the designation made by the Planning Director changed to "Arts, Entertainment or Recreation Facility". At which point the hold shall be removed from our building permit application and allow the building department plan review to continue for review and compliance with the International Building Code. Axe Rooms have gained in substantial popularity in the United States, and many land -use ordinances are only now catching up to how to classify this particular use. This particular tenant 1 owner I operator of Section 37 Axe Room Ashley and Trevor Brennan currently operates Section 37 Axe Room in Boise at 10535 West Overland Road. The existing location in Boise was allowed by right, without any special or condition use. The facility is open to the public Monday through Sunday, with hours varying from 5pm-12am and 12pm to 12am. Section 37 is also available for scheduled private events. Section 37 is the only tenant and activity within the facility, their only offering to customers is axe throwing within designated throwing lanes and from a designated distance. Safety is of utmost importance, prior to any customer throwing an axe within the facility, the customer must complete the safety orientation and display proper throwing technique. In the Boise facility, the customers are allowed to bring their own food, beverages, and beer and wine, no liquor or hard alcohol. Groups that choose to bring their own Beer and Wine are regularly (every 10 minutes) are visited and engaged with by Section 37 staff to ensure guests do not become out of hand or belligerent. Section 37 only offers for purchase non-alcoholic (bottled water, juices, and canned 1 bottled soft drink) beverages. Similar to other activities, such as bowling and darts, Axe throwing is a competitive sport in Canada, and has only recently gained recognition and popularity in the United States. Section 37 is attempting to popularize the sport by offering competitive recreational leagues and recreation play to all customers aged 14 and older,18 and under require guardian permission. All customers must wear close toe shoes. We understand this use 1 occupancy doesn't quite fit any traditional land -use designation, however we feel this particular use is more similar to a bowling alley and its recreational aspects, than an amusement center, given the occupancy is specific to the activity.
