This case is scheduled to be presented before the Caldwell City Council on Monday, November 20, 2017 at 7:00 pm. It has come to the attention of the Planning & Zoning Department that you are in violation of the following conditions of approval for Case File # SUP-07-14: Condition of Approval 9.4 - Comply with State Code regarding the service of alcoholic beverages. Provide security and/or serving personnel to monitor compliance and use a readily identifiable method, such as wrist bands, to identify minors upon their entering the building. Condition of Approval 9.20 - All local, state, and federal rules and regulations shall be adhered to in the operation of the facility. The City of Caldwell has been notified by the Idaho State Alcohol Beverage Control Bureau that you are in violation of State requirements in regards to the service of alcoholic beverages. Please be advised that prior to any revocation, you shall be afforded an opportunity for a hearing before the council; said hearing must be requested within seven (7) calendar days of receipt of this notice of intent to revoke the special use permit. Sam Ketchum from the Idaho State Alcohol Beverage Control Bureau concerning the current status of Salon Columbia. The owner is Oscar Pedraza. It was reported by Lt. Ketchum that Oscar Pedraza recently relinquished his Alcohol Beverage License (Liquor/BeerMine) to Idaho State Alcohol Beverage Control in lieu of payment of prosecution fines associated with violations of the license. The NOTICE OF SUSPENSION letter was issued by Cpt. Doty (ABC) concerning the alcohol beverage license for Salon Columbia on May S, 2017. (see file) Alcohol Beverage Control has communicated the following with Mr. Pedraza: 1) No "bring your own beer" is allowed at the Salon Columbia facility. 2) Alcohol beverages on site are only allowed with the use of a catering permit being issued by the City of Caldwell for events held at the facility. Mr. Pedraza is aware that inspections of the site may be administered by ISP or City of Caldwell safety service personnel at any time. NOTE: Mr. Pedraza has not relinquished his City of Caldwell Alcohol Beverage License to the City Clerk's Office. I will be in communication with Mr. Pedraza to request that the license be returned to the City Clerk's Office immediately. 5ej z'
