(8) Revoking Special Use Permits:
A. Special use permits may be revoked at any time, other than annual inspections, by the planning and
zoning director if it is determined that any condition of the approved special use permit or any other
city laws, ordinances or statutes are being violated. Prior to any revocation, the applicant shall be
afforded thirty (30) days after the date of notification of noncompliancelintent to revoke to become
compliant. Additionally, prior to any revocation, the applicant shall be afforded an opportunity for a
hearing before the council; said hearing must be requested within seven (7) calendar days of receipt
of a notice of intent to revoke the special use permit. Failure to come into compliance within thirty
(30) days of the notification of noncompliance and failure to request such a hearing will result in
immediate revocation of the approved special use permit.
B. Special use permits, including those in existence prior to and upon the effective date hereof shall be
subject to annual inspections for continued compliance with the conditions of approval and all other
city laws, ordinances and statutes. Inspections shall take place by the planning and zoning
department, the fire department, and/or the building department. Permits found to be noncompliant
upon annual inspection may be revoked by the planning and zoning director if compliance isn't
accomplished within thirty (30) calendar days of notification of noncompliance. Prior to revocation,
the applicant may request a hearing before the council; said hearing must be requested within seven
(7) calendar days of the date of the notice of noncompliance/intent to revoke. Failure to come into
compliance within thirty (30) days of the notification of noncom pliancelintent to revoke and failure to
request such a hearing shall result in immediate revocation of the special use permit.
(9) Appealing Special Use Permits And Appealing Or Amending Special Use Permit Conditions Of
Approval:
A. The applicant or any affected person having an interest in real property within a three hundred foot
(300') radius of the exterior boundaries of the subject property may appeal the decision of the
commission, or any condition of approval of the special use permit, provided an appeal application is
obtained from the city clerk and completed and filed with the city clerk within fifteen (15) calendar
days of the signing of the order of decision for the special use permit, along with the appropriate fee
as set forth by council.
B. The council shall hold a public hearing using the public hearing notice and procedures as set forth
for the commission in accordance with subsection (4) of this section. The council may approve,
disapprove or modify the action of the commission and shall do so in accordance with section 01-05-
11 of this code. (Ord. 2739, 6-16-2008)
C. Should the applicant desire an amendment to a condition of approval after the appeal period has
passed, an application requesting an amendment to a condition of approval shall be obtained from
the planning and zoning department, completed by the applicant and submitted to the planning and
zoning department, along with the applicable fee, and a public hearing shall be held before the city
council, the planning and zoning commission or the hearing examiner (i.e., before the same body
which imposed the condition the applicant is seeking to amend), using the public hearing notice and
procedures as set forth for the commission in accordance with subsection (4) of this section. The
council, hearing examiner, or planning and zoning commission, as the case may be, may amend the
condition of approval, delete the condition of approval entirely, or leave the condition in place, and
shall do so in accordance with section 01-05-11 of this code. (Ord. 3010, 11-16-2015)

request. Pursuant to Idaho Code §74-103, the County will make every effort to respond to your
request within ten (10) working days of the date your request was received by our office. Because of
the volume of public records requests we process and the County's commitment to Public Records
Act compliance, we may occasionally require more than ten (10) working days to fully respond to a
request, which we attempt to address in the order in which they were received. We apologize for any
inconvenience this may cause. Although Idaho law may provide that a failure to fully respond to a
records request within ten days constitutes a denial of that request, we will advise you in writing if

NOTICE FOR PUBLIC RECORDS REQUESTS
1. Labor and Copying Fees: Please note that pursuant to Idaho Code § 74-102(10), we will require payment upfront for
public records requests to recover actual labor and copying costs if (a) the request is for more than one hundred (100) pages
of paper records; or (b) the actual labor associated with responding to requests for public record in compliance with the
Public Records Act exceeds two (2) person hours.
2. Form Completion: Please complete the entire form. Failure to complete the form may lead to our inability to provide the
information you may be entitled to. When requesting public records, please be very specific about the type of record you
are requesting. Provide as much information as possible so that we can make a thorough search of our records.
3. Motor Vehicle Collisions: It is the Canyon County Sheriffs Office policy to release traffic accidents to individuals
involved in the accident, or their representative, i.e.: insurance agent or attorney. Some accidents require investigation and
may not be available the day of the accident.
4. Defendants in Pending Criminal Cases: If you are a Defendant in a pending criminal case, you cannot use this form to
obtain records relating to that case. Your request for records and documents must be submitted in writing to this office in
the form of a Request for Discovery, to which we have fourteen (14) days to respond. See Rule 16 of the Idaho Criminal
Rules. PLEASE NOTE: If you are represented by an attorney, your attorney must make this discovery request on your
behalf.
5. Victims in Pending Criminal Cases: Victims in a pending criminal case are not entitled to receive a copy of the case
records. Victims are encouraged to contact the deputy prosecutor assigned to the case or the victim witness coordinator for
information regarding the case.
6. Identification: Please note that identification is not required. However, providing identification may allow you to receive
more information.
7. Response Time: A written response to your public records request will be provided within three (3) business days of the
day your request was received. If it is determined that a longer period of time is needed to locate, retrieve, or prepare the
public records, our office will make its best effort to provide the requested records in ten (10) business days from the day
your request was received. Business hours are Monday -Friday 8:00 am - 5:00 pm. All requests received after normal
business hours (excluding holidays) shall be deemed received the next business day.
8. Legal Review: The Records Section tries to ensure that victim and witness' personal information is protected. Some
records may be reviewed and redacted by our legal department before released.
9. Idaho Repository: The Idaho Repository may also be used as a resource to gain information in regards to any court cases
in the state of Idaho. You will need the person's name or court pumber to do this. The web site is WWW.idcourts.us.
